    Why are you so worried? Dont be scared, make enough money and dont make silly financial decision. You can take your kitty back if push comes to shove. Economies in India and China are booming and you wont die hungry. I guarantee you that.

    Economies in India and China are booming??? booming accroding to their economies not definitely competing with USA what is the value of 1 Indian Rupee in US dollars. just simply dont air some tactics around. As long as 22 Political parties rule India na each one having different agenda Forget about India becoming a developed country.

    And don't dump USA as just like that it is also one of the Biggest and Greatest economy in the world, Still till this moment Dollar Rules. full stop.

    Leave it to us 'Skilled' folks to shred an idea before implementing it. What is the harm in mailing out a letter. We tend to focus on bringing out the negatives and keep discussing issues till the train passes us by.

    The bailout plan is a short window of opportunity, what is wrong in sending out some emails, we are not the only ones doing this there are hundreds of organizations trying to get their word in edgewise.

    (I for one am even willing to write a proposal to 'buy' a GC, if EB applicant is waiting for more than 5 yrs since his/her PD, they can pay 10-15 grand to fast track application irrespective of the fact that the PD is current or not. USCIS stands to make 2 billion. I prefer paying 10k to uscis instead of the yearly drain towards my lawyers SLK.)

    Anyways the point i am trying to make is that for this particular issue send out the letter, ask others to do the same and then discuss the merits of the letter. As the moderator mentions the window of opportunity is very small. Since you will be sending out your own letters, you can include any text to include current home owners or include only US educated or only EB 2 I etc ;)

    So then that is the only way one can SELL you an approved LC?
    there are also genuine cases where a big company will use the labor approved to try and retain another employ. say they file for LC for employee A. it gets approved but A decides to quit. they can then reuse it for an existing employee who is important to them and employee B then essentially gets to the I140 stage.

    Dude, I don't know where you come from but you have a very thorough and deep knowledge of how to run the prostitution business. However, I am sorry to say that you know nothing about consulting business.

    You call desi consulting companies whatever bad names you want, but the truth is that consulting companies are the one who:
    1. Files for GC, the way you ask with no questions asked. (nothing illegal about it)
    2. Helps you maintain legal status while you are on the bench ... If you are working for non-desi company and your services are not required, you get a pink slip.
    3. Pay you per you skills. Contrary to general conceptions, desi consulting companies pay you appropriately (at least most of them) per the billing rate they get from client. Remember it involves cost to run you payroll like payroll taxes and salary of employees, so you can't keep 100% of billing rate.

    Desi consulting companies are not always a blood sucker and desi consultants are not idiots. Infact they are may be more skilled than a IT profession working in big-shot American IT company and doing the same job for last 5 years. Consulting provides you a new job and new set of challenges and technologies to work with every now and then.

    Consultants are the work force driving American IT needs.



    In fact consider the consulting business like prostitution and the h1b consulting companies as no more then pimp.No matter whether my sister or I work for the same.Let me explain the business processes of two for you.
    1.Client is most important in both the cases.No matter how client mistreated you , the pimp will take you to different client but will never snub the client.
    2.You work at client site on odd hour.
    3.It's pimp's job to keep pros under control and scare them of consequences for deserting them. H1b is one such tool and another is too restrictive contract ( 18 months etc ).
    4.If your tech skill got outdated they will dump you ( regardless of contract ) . Old pros becomes "Mausi" and old consultant opens Consulting co and starts h1b hiring.
    5.If you have to have latest skill and for every new engagement client will select from many resume like in pros business. Pros do make etc to be in market.
    6. Pimp will not like the contract to hire clause but h1b/pros will like to have that.
    7. when some one enforces law to ban the business organize protest march of pros . have you seen any protest march by pimps ? Same here , protest march by h1b consultant not by consulting co.

    Try to observe the prostitution business and your profession and there is not much differences except we have illusion and they don't.

    i suggest: take up a collection, then go get top notch legal opinion.
    until you do this, no point going forward, this is going to be a very
    important step.

    c'mon folks step up...get a collection plate out and open your pockets.

    If we reach a critical mass of 50 people - "genuine" people - then it is a good start - the first step can be to look for the best lawyer for this kind of issue. This need not be an immigration lawyer if I am not wrong.

    A main team of 5 people can lead this and form a mailing list to include the interest parties.

    My question is same as saileshdude. What is the trend USCIS follows when previous employer withdraws the 140 petition 180 days after applying AOS?

    (1) Does AC21 letter really go into your file?
    (2) What is the trend that is usualy followed ? RFE? or NOID or Straight denial? - I have seen some posts on forums where USCIS sends denials when previous employer withdraws the 140 petition.

    What makes you so sure the spillover can happen in the first quarter? Is there an example in the last 10 years? You may have forgot Feb. 2008 bulletin. If what you say is true, why it was U for EB2-I on Feb. 2008? No one in USCIS can take the responsibility if the spillover in first quarter causes EB2 RoW with cutoff date later, as they can't predict if there will be enough(or not) applicants to fullfill the quota. Therefore, spillover can only happen at 4th quarter. Unless if there's really mininum of usage, then it may start at 3rd quarter, but I don't think it will ever happen at 1st quarter.

    Look at my prior post. I think spill over will happen every quarter.

    We are all expecting that the VB will go back to June 2007 figure...it looks like that RoW has been so fast in getting the latest PD back which could come in a very few months time.

    I was not expecting this to come too soon but in June 2008.

    Both of these issues are the direct result of low annual limits and very heavy demand for numbers, primarily for adjustment of status cases at Citizenship and Immigration Services Offices.

    PD for Other workers category was U (unavailable)

    E. EMPLOYMENT THIRD PREFERENCE �OTHER WORKER� CATEGORY BECOMES �UNAVAILABLE� FOR MAY

    Yes it will, unless there are more EB1I visas which could spill over to EB2I, in which case EB2I will move ahead of EB3I. But that guy has also said that the spill over may not happen because of the demand for EB1I.

    Its just unbelievable that EB2I and EB3I (i.e. the persons who have PD when the numbers were calculated) will have to wait for about 19 years to get their GCs. We HAVE to do something about this.

    60K EB2-I and 60K EB3-I pending so far. Does this mean Eb2 and EB3 dates will move together from now on for India?

    If it isn't approved.. then it's gonna be cancelled the moment that rule that's pending that comes out..
    It's extremely risky and Feb 04 isn';t that great a PD.. just file new one .. correct way.. and relax.. you will probably get I140 approved earlier that way.. nothing's gonna happen unless laws change and if&when they change.. all PDs will be probably current for 6months to yr..

    It is very likely that these pre-adjudicated cases may be revisited for further processing in future for cases with more recent priority dates. This is just my opinion based on the fact of the predicted slow movement of EB-I priority dates in coming months and next fiscal year. Since so many AOS applicant have been pre-adjudicated , EVL RFE may be issued in future for cases who are pre-adjudicated now but their PD will only become current after 2, 3 or 4 years. This may be to verify that the applicant still has job offer at that time when visa becomes available. So I guess pre-adjudicating application, does it really make sense for later PDs? Any comments on this by other members?

    Hello sir, I am on H1B, a new company is hiring me and they have little knowledge about h1b issues, my h1b transfer is not filed yet, they are 100% sure that they r gonna hire me, but I haven't decided whther to work with them or not, the other day I went to their office to fillout the application for background check but they made me fill out all the forms that a candidate has to fill during the hiring process, they went ahead and filled my I-9 and w-4 forms too. I was thinking that it's all a process of pre-hiring,but after coming home I did a little research and found out that I-9 has to be filled after they transfer my h1b, do you think is it gonna be a problem?I e-mailed them not to put me in the system, did I violate any law by getting hired by them before even my visa transfer process is started?ofcourse I didn't start my work and I am not going to start until my visa tranfer is done. The employment is at will and I didn't sign any contract with them, do you think they will create any problems for me in future(if they want to)?b'cos I haven't decided to work wth them yet and I may tell them that I am not gonna join them. Please advice me I am really tensed.
