Thinking differently isnt bad. It just came to my mind that this may also be tried.
I think we have proved something like this not very long back about 60-70 years back. We have set bonfires of all our imported clothes and said NO to anything made in Britain. Right. So what did we really mean. I am sure many brands we wear today are international too. Nothing wrong.
Why did somebody show the other side to be slapped, did he like to be slapped. Its to get the point across.
Its a way of protest, a peaceful way to get attention to a problem which must be fixed.
If most of you dont agree, then I may be wrong, lets see response.
But lets always maintain that they do care and its a two way requirement and not just ours. We may be desperate due to system failure, but they are too, else there wouldnt be an immigration program. Most countries dont have, if I am not wrong. Its different with US which is a big country and same is the case with Canada which is trying to build.They need people.

Because even with this detailed information on the mechanics of immigration legislation, we cannot figure out who is friendly and who is not and who to lobby to and who to ignore.

The law comes actually down to the following two rules:
(1) horizontal spill if visas available
(2) vertical spill for visas not required
The language in (2) is much stronger. A visa number that is still available cannot be required at the same time. So one could argue that DOS is now misinterpreting the law.
Everyone wants to interpret the law as per their wish. It is nature. However, there is a unbiased place to find the solution for right interpretation. That is called court. Discussing, how DOS/USCIS should interpret the (INA) law in this forum will not yield any result. Even if you contat DOS/USCIS, they will simply say "this is what we understand the law, we have no rights to change the law". Flower or letter campain will not work. If you feel the interpretation is wrong, the only solution is court.
My recomendation is simple. To end retorgression in EB3, it just need more the number of visa. Current INA will not help EB3, and so DOS/USCIS. Only law makers can help to change the situation, by adding appropirate provisions in INA to create more numbers in EB3. Contact law makers. This is the good way of spending your effort. USCIS/DOS does not have enough power to change the law.

I-693, supplemental I-693 (vaccination record) , copy of enclosed documents, blood tests (HIV) , skin test results( BCG), your acceptance for these tests, x-ray report (if skin test is very positive - see belwo) and TB diagnosis ( no TB) is enclosed in the sealed envelope. In original.
The same set is given to you. The medical staff with go through section by section and show it to you (in your copy) that all sections are completed ans signed. If you take vaccination on the first day, then on the third day they will give you sealed cover. [LIST=1]

I would like to point out the differences between H1B and L1
1. There is a yearly limit for H1B (65k + 20K) but L1s are limitless.
2. A minimum wage need clause is there for H1B but minimum wage is not required to be paid for L1s. There are people in L1A visas who are supposed to be Senior Managers are sometimes paid less than 60K per annum by these offshore companies. As although they are brough in L1A visa they are in fact developers.
3. Almost 99% of the L1s are from offshore companies whose main intention is to send the project/job to offshore, most of the H1Bs do not have this intention.
4. L1s cannot change their employer, so they are bound to follow what their offshore employer ask them to do i.e try to take the job offshore, H1Bs can change employers, they will not try to send the job to offshore as they will then eventually have tomove back to offshore.
So if we clearify these points even to the antis, I hope they will understand who is the real culprint for the employment scarcity. Each of these companies are moving thousands of jobs out of this country making the problems for Citizens/Green Card holders/H1Bs.
99.99% of all the L1s are not used as they were intended when the law was signed.
All these may be true. No matter how you convince antis, they won't support any foriegn worker here. They want all of us out.
Even if authorities bans all these L1s, outsourcing will not stop. On the contrary it will intensify.
Before the 2001 recession, many companies were reluctant to outsource their work to India or other countries. When recession hit in 2001, many companies overcame this inhibition and started outsourcing jobs in large scale.
If companies find more stumbling blocks to operate their business, they will find even more innovative ways to overcome those. Remember India is no longer a back office for a low end work now. Many companies have even moved their R&D to India.

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.

2) Look for checks for cashed....

Please refer this document and it will answer your doubt. To be specific L1B resources cannot be deployed in client premises on projects managed and controlled by client (known consulting assignments in technology world). This is just part of the violation. Second... L1B resources cannot be used for general technical skills (java/.net/oracle/production support etc) BUT can only be used for their speciality skills (while processing the L1 visa outsourcing companies shows some internal tools to prove this point). Hope this cleared your doubt, I am pretty sure that now you will be able to find a lot of violations in using L1B resources. L1B resource usage is so common that most of us who are aware of immigrations statuses even doesnt know about this .. forget others including our clients and their managers.

Dear All,
We need to expose the fraudulent EB1 filing by Indian companies! Under the circumstances, I think that this issue is much more relevant now! As such, I would once again like to share the information which I obtained about 6 weeks back from the local Congressman's office.
I was pleasantly suprised to learn that many Indians have been quietly writing about the fraudulent EB1 filing by Indian IT companies to lawmakers! I was told that the local office had received about 50 or so signed (hard copy) letters and that they had subsequently spoken to the INS office about this. It is a good thing that some conscientous Indians are quietly working behind the scenes for the welfare of the community.
Subsequently, I also made a letter on the subject and hand delivered the same the very next day, to the Congressman's office. I then also posted my letter to the Senators of my state.
I once again plead with all fellow EB Indian friends to write letters (please do not Email) about the fraudulent EB1 filings by Indian IT companies (TCS, CTS, L&T-IT, Infosys, Vetri software, et al) to your local congressman / senators. Please also visit your lawmakers to follow up. Personally, I feel that this very very important. IV is there to help us, but all of us must also play a role to get results
It is the strategy that will win the war, not always brute force! We should adopt a multi-pronged attach strategy, realising that each ever visa no. we get is important!
Spending about an hour of your time to write, print, sign and post could save many atleast 2 years of wait time. Did your realize this?
Imagine the impact of 1000s of covers getting dumped in your law makers' offices!
Even lawmaker's offices feel that the impact of printed and signed hard copies is much higher that Emails!
If we are united and focused, we can all win!

I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

FINALLY I GOT MY PP with Visa Stamp today !!!!
the status changed on the VFS website 'pp delivered' in the morning around 11am.
Here is my case:-
Int for H1B renewal, same company same job, at New Delhi consulate - 14th Jan. VO said "approved, you will get your passport couriered to your home in a couple of days'.
10 days went by and no response. By Feb 1st week, i started calling DOS ..DOS confirmed to have sent the clearance on Jan 25th..
Since then my lawyers and me have been trying to find out the reason for delay from both DOS and embassy.. NO LUCK @@
today on Feb 12th..30 calendar days..i got my pp back. And I am flying back home tonight.
Thanks to everyone who helped me and supported me during this long wait.
In my opinion my case was delayed only for PIMS..but since i had H4, F1, studied at 4 schools, and fairst H1 and this H1B renewal..it took VO good amount of time correlate and work on all this.
I guess mostly delays are for renewals and for people specially with longer history in states. The embassy's are swamped with work and now days a general processing time has been made to 30 days. Infact its also mentioned on their website that most cases are completed withing 30 days..Just FYI..even for PIMS verification, the embassy will report to you as administrative delay.
I hope all this helps to people who are still waiting and who may have long waits in future.

Do you know why we are having GC delays ?
1. Country cap for visa numbers
2. Visa numbers wasted by USCIS by their inefficiency
EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?We always find it easy to go against fellow immigrants than fighting the injustice at root.

I agree with you that the main reason for the GC delay is the two causes you have mentioned. The Country cap is based on the current law (I am not saying the law is good). However along with the main causes for the delay the fraudulent uses of EB1 visa #s are also causing extra delay. Thus along with the effort to remove the main cause of delay we should work on the other cause of delays too.
I am also agreeing that as per the current law the L1A - Senior Level Manager can get their GC processed as EB1 and get GC within six months. I agree that this is the current law.
My main concern is the misuse of this law. People who should not get L1A visa are getting L1A using fraud and taking the EB1 visas which otherwise as per law would have trickled down to EB2.
You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".
You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.
Regarding donating to IV think I am not accountable to you. Please note that this is a forum where everyone can express their views without attacking each other personally.

Some ideas are good. In order to implement them, we need support from members. Pls volunteer and take up the ideas to lead them. For example I have mentioned about poster and banner campaign. If each one of us, prints them and post them in various places, we can get good publicity.
We have to make do with such low cost volunteer work. Someone pointed out that we should contact newspapers and get articles published. Wish it was so easy. We have written tons of mails but that alone does not work. You need to issue press releases and publish them online. Publishing them each online costs a couple hundred dollars by publishing services who distribute, and there is no guarantee it will be picked up. Thus you need a focussed campaign for it. There are services where you can contact reporters and media on a specific topic and send them email, press release directly. If they are already writing article you can know the deadline. If you have an idea, you can pitch a story idea to the reporter directly. A good service I know costs 5K for non profits for one year. If you need access to International reporters database add 2k to it. All this is possible only if we have these kinds of resources. When we can hardly get contributions of 5k in 4 months after collecting $5 each, it is tough to plan a big media campaign. The reason why other big organizations and big anti immigrant orgs can get so much publicity is that they probably can spend their huge resources on such services. They can also afford a full time staff. We do not have all that and run IV along with our full time day time jobs. So the first thing we need to do before we run any campaign is to get more members and more contributions and monthly signups. Without that ideas may only remain on the forums.
