Hi All,
I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

So , the USCIS says they get 39% positive response from FBI namecheck. Does that mean
for those 39% the GC/Citizenship is denied? I haven't heard much about folks getting GC denied because of critical FBI report. The Ombuds is unable to determine how much of the 39% positive response cases were already covered by other means of check. .
I think their reasoning could be like this "Even if 1 million good guys are put to difficulty because of the false hits, if they can catch 1 bad guy with the process, they will continue to do so". The only solution appears to increase the resources/money.

They should have your info unless consulate hasn't sent it. they use your passport number as reference. so call again if they didn't use your passport number to search. in any case ping the consulate again.

Actually this time I asked my friend in US to call DOS, and he used the computerized answering system with my petition number and they did say that my H1-B petition has been approved. I don't know if I mispronounced/mistyped anything when I did it last week, but at least now I'm sure that it is on DOS' system. Thats the same thing I heard when I called KCC, that my petition was approved in April 2007. Or maybe I should've asked them if they've access to PIMS. It's frustrating man, I never thought at this stage of career, entry-level that is, I will be stalled by things like this. Well I hope in the end I can find a rational explanation to why things turned out the way they did.
For the new folks in the forum, its been 75 days and am still waiting for my H1 visa. I guess I should also talk to that Mexican Emabassy and see if my case shows up on the PIMS or not. The only problem with New Delhi embassy is that when I call them, all they say is that the case is still pending, and nothing else. I don't even know if I should curse them for being incompetent, or maybe that is all their job entails (I'm not being condescending here). Is it advisable for me to go to New Delhi personally? This is a mess, but as long as its in God's design, I'm ok with it. I just don't wanna feel later that if I had done this ... blah blah, then I could've expedited the whole stuff. That'd be a bummer. Well at least I need to be focussed and keep my head straight. That I can control, and thats what I'm taking solace in.

After so many countries who receive major immigrant influx like UK, Australia, Canada and New Zealand have implemented a points based system why on earth lawmakers here don't wake-up. In a post-crisis world if US does not regain the old economic supremacy we'll see expatriate population redirecting itself.
It's already happening with Canada's AINP program. If some of the anti-immigrant comments are to be believed Canadians must be darn fools :D

I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

Why do we need 325A?- i thought this was for people in illegal status. Our son entered the US on valid H4 visa. Also do we need to request in application to attach the file to mother or anything like that. I will give the USCIS a call and share that information here if I find anything more.

I was unable to file for my son since he aged out over a year ago because of long delay in labor cert. However, I filed for my spouse and we both submitted G325A in accordance with instructions from my international services division at work.

I do not know how many times this topic was discussed accorss various boards. Because of INA and amended provision in Ac21 act, all the unused visas from Eb1 goes to EB2 and if anything leftover in Eb2 goes to EB3. This is the law. This hurts badly EB3, as demand in EB2 is so high to consume the all the avialable Eb2 numbers. Moreover, country quota is not applied in each employment based preferece catagories seperatly /exclusivly, if the demand in each catagory is less than the supply. So, most of EB2 numbers consumed by India and China as worldwide demand for EB2 is very less than supply. There is no confussion in it. This is the law. Though it is unfair to very old EB3 folks (in their view) One cannot do anything to change it. unless congress rips of the AC21 provission by passing new law.
It is difficult to accept that a EB3 guy in 2001 pd stll waiting and 2006 guy gets gc. But this is what law is, USCIS/DOS can't do anything. If we talk unfairness, there are tons in US immigration. A friend of mine forgot (!!) :confused: to renew his EAD when it expired last September. He then applied for renewal 60 days after the expiration date and got his new EAD without any problem, no questions asked!
I filed for my own renewal about 90 days before the expiration date and when about 85 days had passed and I was getting worried, I called USCIS and was told: " Do you need the card to show your employer that you are legal? No? Then, don't worry about it. As long as you applied on-time, you are fine." I actually received the EAD five days after the expiration date...
These two experiences are from California Center.

NO LUD after Feb 2009 when i did my second finger printing.
Created SR thru NCSC, did not help.
Went to Infopass, no help from ppl i spoke with there.
Did congress man enquiry, not sure if this helped. (as of yday, they had not received a response from uscis and were still waiting for a reply)
Sent letter to Ombudsman, they told me they were checking with USCIS...
No Idea which one worked... Good Luck to all of you...
