During the discussions on 1485 filing provisions we there were questions related to EB2, EB3 backlog numbers post 2007 july + Based on the recent information we got on pending numbers + our discussion on if EB2 will get current this year helps us understand how the last quarter will behave. VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter. It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.
When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.

(3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.
Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.

No one is sure where you case has been sent to (at least until you get receipt...or even after that). Weekly updates only tell about the cases each office decided to keep. No one knows about transferred (or yet undecided as to where to send) cases...weekly updates don't apply to them !!!

I am sure they are PDs ..see sudden spike in mar 2005. If it was ND or RD you would see that spike in Jul - sep 2007

You know every time I hear the so called "highly skilled and educated" complaining about predatory lending, it reminds me of our maid servant in India. She would constantly get into trouble by borrowing money from her neighborhood sharks at high interest rates, and then come to my parents for help when she couldn't pay up. My parents would give her a well meaning scold, and help her out only because they knew she was illiterate.
Now I wonder how these guys like punjabi7, kumar1 and leo2606 can blame the lender only for what they got themselves into. They even go as far as claiming that moral, ethics, and scruples are all some kind of fairy tale virtues that are hardly ever practiced in real life. They even have the audacity to assume everyone else here shares their definition of what's right and wrong by saying everyone has at one point or another returned used items to stores!
Punjabi7 still insists on avoiding morals in the discussion and is persistently soliciting for "advice/options" for his so called mess.

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.
Punjabi77, good luck to you buddy. This will pass too, don't ruin everything for $20K. You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

I dont get this - the PDF clearly mentions that the table is for ALL PENDING EMPLOYMENT-BASED 485s. So that means: -
1. It does not include any Family-based 485s.
2. This is not a count of just pre-adjudicated cases - this is a count of ALL PENDING CASES.
3. And since this is a count of ALL PENDING CASES, it also means that ALL DEPENDENT CASES are also included in this count - all DEPENDENTS HAVE TO FILE THEIR OWN 485s!

Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

Why do we need 325A?- i thought this was for people in illegal status. Our son entered the US on valid H4 visa. Also do we need to request in application to attach the file to mother or anything like that. I will give the USCIS a call and share that information here if I find anything more.

I cannot name any lawyers in my post, so I leave it up to you whether to treat this as serious advice or not...
My lawyer says USCIS does not allow one person to be represented in more than one 485 applications....whether the person is primary or beneficiary.
My wife's lawyer (I won't name this lawyer either) says there is no prohibition on filing multiple 485s.....however, it's just a waste of money (her opinion).

Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?
I don't know if procedures are different in the consulates..In my country you apply for H1B visa ,they interview you and tell you that you will be granted a visa so we will call you when stamp is ready...you take your paaport and yoiu go home and whenever they call you for stamping you bring your passport and stamp it the same day...Are procedures different these days?

Plans touted by Justice and Home Affairs Commissioner Franco Frattini, the man charged with developing common immigration policies for the European Union, range from a new EU-wide "green card" that would allow skilled workers already in the 25-nation bloc to change countries without extra paperwork, to special temporary permits for seasonal workers.
"The U.S. and Australia have stricter rules, but they get the right people to immigrate, and once they're in, they integrate them, and give them benefits, education and citizenship" much faster than in the EU, Mr. Frattini said in an interview.
We should try to educate Mr Miller on the US process.

If they were submitted on 8/30/ and it's not cleared yet and your derivatives are cleared then more than likely you are stucked, there is some probability that you might be cleared in few weeks depending on number of hits generated against your name and avaialibility of the documents needed to be refered by fbi to clear you. However you dont need to worry much because now a days fbi seems to getting work lot faster then it used to. Also since july fbi has increased the fees that they charge USCIS to do the check which has increased the staff at NNCP and so the efficiency. I would suggest for you to wait 60 days and try again. Hopefully you have good news. I have been waiting 35 months.

After filing I-485 one single thing which gives butter-flies is NC. Just a Look at your and CAdude posting shows how terrible is NC and how difficult it is for those unlucky ones to bear this uncertainty. God bless all !!!

Whatever way it is USCIS has again lived upto its July fiasco, return I 485 applications without accepting and now send the flowers away to hospitals without accepting....end of the day...no evidence left behind..
