My attorney is not including any w2s/tax returns at all. According to her, their firm never files these documents and got many approval without any issue. Did you see any instructions in 485 forms that says that they are required?

W2's/tax returns are not part of the initial evidence USCIS requires to process your application but they may ask for it later if required

Your Case Status: Card/ Document Production On September 22, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

Now I have to wait.. I will skip tomorrow's lab  and talk to my attorney. Confused yet happy

I had sent the four letters to different service centers. Got a reply letter back from TSC.
The letter says "Thanks you for your recent inquiry to the Texas Service Center (TSC) via letter for information regarding your case. ....." Seems like a standard letter template.
They returned my letter and even the envelope too. :)

I am assuming they have a clerk who has been instructed to do this.
Lets not worry about it, lets keep sending the letters

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.
    Just a thought

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. But once the teacher was out.....maan his ass was all red in the hostel, in the class.....just kept running away from every other fellow student.....

The item mentioned above is for EB2, meaning any spill over to EB2 is from unused EB1.

for EB3 the ACT mentions the following

Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

The meaning is EB3 gets all unused from EB1 and EB2... This is the catch, does this mean spillover from EB1 after EB2 catches up (or) spillover from EB1 even if EB2 is not current..

If they have done spillover from EB1 to EB3, even when EB2 is not current...we can give this a try.

Sorry for the confusion...Just got excited and went over the allocation of visas from the ACT

    http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=cb90c19a50729fb47fb0686648558 dbe

It actually comes down to the language. I haven't read the rollover from EB to FB (if at all it happens), but look at the language for EB1. It talks about regular number + any not used by EB5. The language for EB5 is lost when it trickles down.

Does it mean: 1. EB5 can only be used by Eb1 and not rolled down further?

    or

    2) Does it mean that any of the EB5 unused numbers that are also not required by Eb1 rolls down to EB2.

If it is choice 1, then I suspect we have no case. If however, it is choice 2, then it is clear through the language that spill over Eb1 goes to Eb2 and EB3 at the same time. If not, based on the language of EB1, Eb3 would have just said "unused numbers of EB2", which means it would use Eb1 numbers only if Eb2 did not need them.

Suggestion to go via AILA is a good one, but do we have contact into AILA??

Good news for your guys. I am EB3 but recently my labor got approved in EB2 and very soon I am going to port PD from old labor. :DHa..:Dha..:Dha..You cant stop me and very soon I am going to stand in front of you in EB line.

How come you couldn't file in eb2 in the first place? Not a personal statement, but I'm still trying to understand this matter.

    Absolutely unbelievable-
Get this: A fingerprint check takes 24-48 hours but a name check takes upto 6 months!!! There are over 8 billion individuals on the planet, and how many have duplicate names? OK, now how many have similar names? And by the way, if you already have a fingerprint, why does name check take so long?

Reminds me of the scene in the recent Simpsons movie, where the government guy jumps up and shouts "Woo Hoo, we actually found someone we were looking for!". The bromide goes that truth is stranger than fiction, but it should be amended to "The truth is more idiotic that fiction".

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.

What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

    Hi pat123

    The details are:

    RD: 8/07/2007
    ND: 9/17/2007

    NSC
    RD: 7/20/2007
    ND: 9/19/2007

So our NDs are very close to each other (9/17,18,19), perhaps it is pre-adjudication that is going on? Are y'all NSC as well?

    Hi mckottayam,

Thanks for your question, while we don’t have a Vonage plan that can be used on your cell phone right now, we’ve got some exciting mobile news in development. Stay tuned to Vonage news on our Facebook (http://www.facebook.com/vonage) page and on our Twitter (http://twitter.com/Vonage_Voice)handle!

    Best,
    Michael

MY friend just spoke to Lingo, they are coming up a cheaper(may be $1 or $2 cheap) plan with unlimited to India/China and 101 countries and also can be used from a registered cellphone incase you do not have internet for any reason.

So, wait for couple of weeks and then choose the right one.

My priority date is current this month (Sep. 2010). An InfoPass appointment inquiry on Sep. 3 and a congressional inquiry on Sep. 9 answered that my case is being actively worked on by an immigration officer since Sep. 1. SR on Sep. 10 responded that visa numbers are not available for my case. SR response was dated Sep. 10 same date when it was initiated. On Sep. 15 my I-485 got approved. And here is the funniest part. I received the I-485 approval notice and the SR response that said no visa numbers available on Sep. 20 both on the same day by snail mail. What a contradiction? Such are the ways of USCIS. Why do we not want to question them? Would raising this issue with the Ombudsman be of any use? Can this be presented as a proof of a hideously mismanaged government entity?

Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

I Am Sure This Has Been Answered Many Times, But I Have Not Been Able To Find Any Information About This.

As A Consultant, One Has To Travel To Different Places For Different Projects.

So What Happens To His/her Gc Process.

What I Have Been Reading Here Is That The Place U Get Your Labor/i140 Cleared And If U Move U Have To Get It Again.

I Am Novice In This Area And I Hope I Am Asking The Right Question.

I Will Really Appreciate If Someone Could Shed Some Light On This Issue.

pro-bono -> To work for the good of the public rather than for a profit or income.

Looking forward to the coming year, our goals for outreach expand to certain pro-bono cases and lobbying for improvements in laws and procedures to benefit our clients and U.S. businesses that are suffering as long as caps and retrogression remain as they are. We will continue to fight for you and your causes in 2006 and beyond. We will further strengthen our fight for better pro-immigration laws. We at the Murthy Law Firm will work to persuade the USCIS to issue opinions and letters that better address the business realities, requiring faster decisions and interpretations to help the business community and unite families - all for a better America!

Because you still need a visa to enter the USA (though you have an H-1B approval) and application for the visa abroad is not always easy.

This guy doesn't have a clue. He is deviating so much from the core US policy, I don't know where it might end. I wonder whether we are better off with the last one????

If Obama signs this bill into a law, this will be the end of Capitalism and some extent Indo-US relations. India may drag US at WTO followed by backlash here. so this will make things for immigrants really tough in this country. So go figure out....Obama & socialism loving maniacs. Durban & Grassley did not have permission to visit Bush's whitehouse. But ofcourse Obama loves these clowns.
