Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.

If you think that you can fool everyone all the time, you are sadly mistaken. Even by DOL estimates, there is 20% fraud with H1. The real figure could be a lot higher than that

I filed for my wife ( I have a Unique A # and so does my wife A#)
My WIFE filed a seperate 485 with her 140 for herself. Her A # here matches the previous step. We did it so that my name did not appear in both so there will be less chances for a cancellation. I will do follow to join incase my wife applns goes faster
We applied AP and EAD for both of us, using my Application.

Can POJ be only be used for cases that were seperated? Last time, I used the POJ method, the IO told me to talk to the CSR and he refused to give me the status of my case.

Congrats!!!! Can you please tell the SR process? Do we have to tell the reason why we want SR on the case? If yes, what was your reason to open SR? Thanks!

FYI: I opened SR on Aug 4th... Yesterday I got response that my GC is approved (but the status online was still Initial review) and now today morning my status changed and I got approval email and an SMS too.
Given the above, I seriously think SR works. They must have checked my SR and then approved my GC.

one update: after a month the consulate asked me for a scaned copy of my I-797 aproval. sent it to them the that very day. called them up two days later to confirm if they recieved it and if the processing was done? the answer was "yes we recieved it" and "sir, it will take time" .. has anyone been requested for a scanned copy of their 797 by Chennai or other consulate?

I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
This is not August bulletin.
Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.
I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.

Why some attorney are advising and some are not?

2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

There are two waves of movement going to happen for EB2 this year. One starting in May and the other starting in July.
The 12000 unused visa numbers from EB1 is not the total for the year 2011. It is almost certain that, this is the spillover from the first 2 quarters of 2011. Along with this, there are some numbers from EB2 ROW as well. The spillover will only get applied to all those countries which are retrogressed.
12000 visa numbers would move mathematically the dates to somewhere in Sept 2006 for India and China Eb2. The porting from EB3 to EB2 is still a factor, but that won't exceed more then 1500 (which are ready to be assigned visa).
In order to utilize these 12000 visa numbers, USCIS may possibly consider 15000 applicants so that they will get 12000 approvable, background check free and non-delayed cases.
So, i think for EB2 the dates could move to either Oct/Nov/Dec of 2006.
In July, the next wave of spill over could move the dates further into 2007.

IMO, stopping and working against fraud can be a bullet point in IV's portfolio. It could help IV while discussing issues with lawmakers.
