I doubt it whether he knows about the USCIS has changed the spill overs to horizontal fall outs and due to that the number of visas added to EB2 India/China. The horizontal spill over is giving a greatest adventage to EB2 India and making it run to catch up CURRENT. I see in the link http://www.immigration-information.com/forums/showthread.php?t=5456&page=8 , in one post he is predicting " I expect to see substantial worldwide EB3 movement during the next fiscal year." . But its not true because the EB3 world wide wont have many visas as before from now on. The EB3 world wide will move based on the 7% quota but not more than that.

There is definately an element of risk and it is high in case of LC substitution. In my case, the LC said that the candidate should have MS and few years of experience and I didn't satisfy all the requirements and eventually got a query from USCIS and rejected the application.
If you can get it approved through a good lawyer like Sheela Murthy or Rajiv Khanna, then you can make a decision.
At times, USCIS doesn't allow to substitute MS degree with experience and it depends on the wording of the LC.
I'd read about this in different forums, talked to lawyers and friends.
Still, you can talk to others who've done it and then make your decision.

The logic being applied at the NotCanada website is perplexing. Yes, the Canadian immigration system can be improved, but people who qualify to get in think by stepping foot on the soil their lives will be all peachy are delusional. It would be like any of you EBs coming to the US with no job offer. How long would you survive? I doubt 4 weeks. You wouldn't be able to rent a place, get a credit card, or, duh, have a paycheck. Obviously you think US is easy because when you come here, you're already employed. Canada can improve immigration system by encouraging immigrants to look for jobs before carting their entire families over. But still, the burden is on the immigrant to use their common sense. Canada, nor any country, owes you a job of your liking. YOU have to take care of yourself. It's mind boggling that an educated doctor from another country doesn't ask one colleague, or research the internet, or apply for a job, before immigrating to a country on the otherside of the planet.

More than the money, these guys are plain stalkers! They don't leave you even if you are not interested and even after blindly telling them right on their face. Anywhere you go, Costco, Walmrt, Indian grocery stores, Malls these guys are right behind you. Next time i am calling COPS and i am going to report these guys.

Because of all these experiences, even when you genuinely smile or strike a conversation with a desi, he/she first suspects you to be an ammway guy. I face it everyday, being "outgoing extrovert" in nature, I tend to smile and talk to people in elevators, walkways, malls, restrooms, groceries etc... which is mostly casual fun stuff and most times desis suspect that I am a ammway guy and cut me out harshly.
Enough of leaving it or taking it lightly becasue of so called "your countrymen" stuff.

I completely agree that Substitute labor is being used is the wrong sense. My husband is now in his 7th year of H1B and I am still on H4.
At the same time our friend who came in 2005 to USA through an Indian company joined Rapidigm in 2005, received a 1999 priority date Labor and received his Green card (& for his wife too) in 8 months time.
This iextremely unfair means of acquiring GC and should be blocked legally.Meanwhile Rapidigm has been acquired by Fujitsu .

we have much bigger fish to fry than worry about few smart crabs getting out of ship.
sub labour is not illegal nor it is a loop hole, itz a simple deal between employer and employee for their own benifit.
letz focus our effort on making new congresss and senate understand our situation and provide some relife thru bills such as SKILL.

The VIP culture and the sense of entitlement in India is sickening :mad: I would understand if George Fernandes had raised a fuss since he was travelling as a diplomat, but SRK is pure dung!! Not really the biggest barrier is same or similar job. It is absolutely unfair no not let someone grow into different areas and keep the job exciting. I personally had to pass on so many opportunities even within my own company because of similar job constraint. In fact in many good companies including mine the executives encourage you to get experience in different areas of business before you are considered ready for executive positions and the VP of my division clearly told this to my director that i need to move on to a different job area. In general the AC 21 is risky and if you are waiting for 6-7 years you may not want to take the risk as USCIS make decisions which are unreasonable. AC 21 is also not a law and is subject to interpretation. The deal is that it is completely unfair to not let a person grow professionally and let him or her try different careers. Granted some folks may like to stay in same job area and continue what they are doing and these changes will not impact them but for those who want to try something different every few years this same or similar job rule is a curse.
This benefit already exists under AC21 (after 180 days of filing). Allowing you to ditch sponsoring employer on the first day of filing I-485 defeats the whole idea of employer sponsorship.
