If they have info about non-availbility they will announce now rather than waiting for monday morning . Also they will be in deep trouble by moving the dates without accepting single application . As AILA reported they will do it either on monday evening/tuesday quotaing the number of application received
Dates have nothing to do with number of applications received. Visa numbers are allocated when a I485 is APPROVED. The only way dates can go U is if they APPROVE so many 485s that all of this years visa numbers are used up.

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

I knew friends in Kaiser who were hired on H1 and got GC through Kaiser..
How the hell can they justify filing new GCs, but not accepting EAD!?

In case you havent seen my posts befre, I have been stuck due to PIMS for 56 days !

I had my interview for an H1-B at N. Delhi consulate on December the 5th, 2007. The consulate officer told me it needs administrative processing and gave me a pink slip. I was also told that it may take anywhere from few days to 7-8 weeks. Today is February the 8th, 2008, and am still waiting on my visa. So if its any consolation to you stuck_here, I'm stuck here for almost 65 days now. Given that I have a PhD in Chemical Engineering, I might have fallen under the Technology Alert List, but, still, the wait time seems ridiculous. Any ideas from anyone about if there is anything I can do on my part to expedite the matters? Thanks.

Excellent idea JBR. Why don't you create a letter template and put it in IV. If we have the facility to sign electronically, it will be nice. Later, it can be sent electronically to all Congress Members. Let us try to create a slogan for our campaign. Any IV member can shed their ideas on this.

Why has AILA not yet filed a class action lawsuit? Why have no lawyers filed a lawsuit on behalf of the entire community?
Let us ask thiis question to all our lawyers and ask them to communicate to AILA? Speeding up namechecks will truly help immigrants and will annony employers who want to keep us waiting as long as possible.
This is an open question to all lawyers reading this post. If you can file such a lawsuit, it will be a big help to this community and you will prove to us that you truely care for our cause.

I just received my 2 year EAD. Priority date is Nov 2002 - EB3 -India. Well I guess that says it all. If USCIS thinks that Nov 2002 will take at least another 2 years then I dunno what about the rest. I didn't wanna think about EB2 porting being so close and spend another 10k, I guess just need to stop worrying about it now. :)

This is my case in brief:
I resigned from company A (who sponsered by RIR LC, and I-140) about a year back.
Filed I485 using approved 140 of comapny A in July 07, in the485 application we mentioned the details of the current company I am working in. Got EAD and AP approved. (Company A's management is co-operative and supports me to take back)
Also got 3yr H1b extension approved for current company based on the approved I140 of company A.
Now Iam traveling to India. Had an appointment in Chennai consulate . My previous H1B visa expired in 2004.
Will there be any issues with that much gap 4yrs, in getting stamp?
Is it an issue not working for GC sponsoring employer?
If I use AP what are the issues?
If asked at PoE (Newark EWR) why not working with company A? what should be better answer?

If that is the case you have legitimate reason to take this matter with your local congress man if their legal cannot clear them.
Follow the suggestions of experts in this thread. I suggest you to contact your local congressmen. They would definitely help as in my case they did to expedite EAD renewal.

Colleagues who sent on Aug 10 Receiving RNs. Its getting so frustrating now...I called USCIS again 3rd day in the row and still nothing in the system.

did you get yours without CPO mail ? My case is same. No CPO, though got approval/decision emails and approval snail mail.
I got the CPO email first. In another days 6 days got welcome mail. Then the status changed back to post decision activity. 5 days from there, I got the cards. Even today the status says the same.

Hi All, I had a quick question.
My I-485 got approved earlier this week from NSC and I received the approval/welcome letter by USPS.
My online status is at post-decision activity and not at CPO.
Though my welcome notice says that I should receive the card in 3 weeks, I am wondering if I need to be at CPO status before that happens....also I read somewhere they may require another FP before CPO (that was talking more abt transfer cases, but mine has always been at NSC).....but nowhere in my approval notice does it ask for an FP.
I was wondering if I should just sit tight and wait for the physical card or try to find out more information.

This is what i am doing to call a cell phone or any land line in india. Vonage has a call forwarding feature. Simply log in to your vonage account and go to features and configure the call forwarding feature.Configure such that the call is forwarded after 20 sec's. Intially vonage rings and after that it is forwarded to the india cell or landline forwarding number. Its free of charge as calling from vonage to india #'s is free. Hope this puts the debate to rest.
