US news has covered a book by David Heenan -- "Flight Capital" that essentially deals with the fact that high powered immigrants are leaving this country -- for whatever reason -- and how its bad for America. BAD FOR AMERICA. forget about it being bad of GC aspirants. ITS BAD FOR AMERICA. And we have one of america's own high powered former CEO saying that

This man has no vested interested in talking about this. Obviously he does not need a GC and he is not on H1. He makes our case. How anti-immigration congressional measure are hurting America as a nation as much as it hurts aspiring immigrants.

LOU DOBBS TONIGHT
http://transcripts.cnn.com/TRANSCRIP...28/ldt.01.html
DOBBS: It's pretty remarkable. Two million people legally admitted to the United States each year. Four hundred thousand H1 visas each year. Nine hundred thousand other employment visas each year. Six hundred thousand student visas issued each year. Four hundred fifty-five thousand temporary employment transfers granted.
In addition, over 700,000 legal citizens. In addition, a million permanent residents. My gosh, what in the world are you folks talking about?
1 para from How many H-1B visa workers? Counts vary (http://immigrationvoice.org/forum/showpost.php?p=114543&postcount=737) VALLEY EMPLOYERS AMONG TOP USERS By Chris O'Brien (cobrien@mercurynews.com or (415) 298-0207) Mercury News, 07/15/2007
The federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap. It doesn't include the 20,312 applications the government turned down.

trying to understand your problem?
the goal (and you may have to chew on this a while) of this campaign is not to bend rules. it is to create media attention for our problems.
this may be a catalyst to anything- 485 filing, bridging amendments...who knows?
the point is we have to keep trying. sounds like you want to slink away into your "reality". well, since we are all living in fantasy, friend, please let us enjoy it. thanks for your encouragement btw.

FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.
What you heard is probably true, I was a customer long time back and wanted to disconnect, on top of stern response and attitude, they charged me for the whole month instead of prorating it .
I like the new plan , may be I might buy it but if vonage has done this there will tons of other companies who will slash the prices or atleast match vonage.
The world wide calling if great if you are calling your home country everyday or the phone card companies are costing you more than $25/month(air tel and others). Besides $25/per month these days is ridiculous(before the free worldwide calling plan). You can get a GOOD VOIP service for $10 or even under that these days. Just good "voip service providers"
Bottom line- Great plan by not so great cust serv company

When you say "according the our calculations", and you can only come up with years (& not 1 year, 2 year), you have obviously not done a very accurate calculation/guestimation.
I wouldn't put too much stock into it.
There are two years (2006 and 2007 ) from 2006 to 2007 and you know language of all lawyers, so he is not wrong here too. I bet you if you can convince him to say 1-2 or 3 years.

Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.
Yes there is one. I was teaching Consumer Ed for ELL students (at high school level) and we were studying how to deal with interviews. According to the law (please refers to DOL agencies- They can help you) NO BODY can ask you if you are a citizen or legal resident during an interview. They can only ask you if you are authorized to work in USA legally. If they ask you if you are a citizen it is discriminatory and you have the right to do not answer explaining your rights. A good HR guy knows about that!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
So this guy from Capital One made a huge mistake to mention the EAD (he could be fired because repercussion of this email. Of course they can discriminate when they are going to make a final desition. It happens in USA a lot. If you have a pregnant woman probably you are going to choose one who is not. But this is not the point. The point is that if you tell the girl sorry but we don’t hire pregnant women they are death!!!!!
Please find more information at DOL website. Many Universities have fliers explaining your rights in HR office.

its ok, you misunderstood my point. I dont want to divert OP of this thread.
Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.

That suit will not stand a chance, not becasue it doesn't have legal merit but because it goes to the core of capitalistic system. Coporations can choose to hire and fire anyone as long as they don't fundamentally descriminate in writing. All of us know, that employers and hiring manangers have their preferences that might actually border legal descrimination so this is not an immigration issue as I see it. This is a broader issue linked to the power vested to the corporations in a capitalistic society, I have seen ethnic bias, age bias and all other kind of non-sense in hiring. Anyone claming that this doesn't happen or this is an immigration issue is simply in denial. It is just the way of life. As BharatPremi has pointed out, law says descrimination in the documents after hiring is illegal but it doesn't say that employer cannot choose to hire anyone as suited. Equal opportunity hiring practices are just guidelines which says job requirements MUST be uniformly and consistently applied to all race and color. It doesn't say you cannot choose to have an all white or all black work force. Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. Using the same logic, they can avoid interviewing an African American.
I think we all should get together and file a class action law suit against those companies.

Keep up the good work
I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D

USCIS has become efficient, by this time all (or most) of the EB2-I visa might have gone. I am wondering any 2005 approvals?
Basically this would give some idea, what to expect in Nov.

Hello every one,
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
You know some people meet all these conditions with the exception of approved i-40 and don't even have a pending Green Card application because their employers are just waiting for their H1 to be used up and then "kick them out".
I think if you meet all the conditions enumerated above, u should be automatically given a Green Card.
