I had called up USCIS and they have transferred the call to second level IO, as my application is 90 days old. They donot find the information yet. (My employer says, they clubbed the applications in one fedex box and sent it. Got the list of FedEx tracking number, one tracking number has 4 pounds, so guessing he would have put my application in it. ) The IO says, I have to take the fedex tracking number printout as proof and send them by postal mail, so that they can track back with their computer systems. Do now know when I will receive RNs. May be I have to maintain another tracking number for this inquiry mail also.

Friend I just called to USCIS.No information yet and she could able to find all my I-140 info and my employer details. But no information beyound that.I requested her what should i do..it's been 90 days? She said wait for 2 more weeks ..they still have lot of applications it seems and it may take 2 weeks to one month.

I received the same thing. A canned reply asking to use their phone lines for inquiries. They returned my original envelope as well as my letter :rolleyes:

I sent in the four letters 2 weeks ago and this week I got a mail from TEXAS Service Center. They returned my letter in original and they also wrote a big one page letter.
I don't have it with me right now but in it, it was mentioned that "Please call us at our inquiry center if you have any inquires or you can check your status online as well as the recent processing times.
Don't know if others are also receiving the same returned mail but I wanted to let you guys know this as an FYI.
It does not seem like the letter reached the person to whom it was directed to.

So, I guess it all boils down to what is the legal status of somebody who has 485 pending, EAD, and AP? At that point you are no longer on H-1B. Is this status covered in the definition of a "U.S. worker"? ... Anybody?
As per Ron Gotcher, "Anyone with I-140 portability and an EAD is a "US worker" as that term is defined by the Department of Labor.".

Hi,
This thread (forum as well)seems to be really enthusiatic abt the immigration reforms.
Keep it up! I am a new member to this forum who had been passively following the S1932 disaster on immigration.com forums.
Hopefully things may look better with the new bill sponsored by Arlen Specter.
The bill looks good but how do we know that it is this bill which will be discussed and not the other bills sponsored by senator hagel,mccain etc..
Question is even though this bill seems to be a consolidated effort of all the previous bills how can we be sure if this is the bill which will be discussed as part of immigration reforms in feb?
Also this does not have any clause for applying for I-485 before cut off date?
So the people who benefit through this bill are probably the Masters/Phd who can automatically adjust their status and the people who have not even applied for a GC ( since no labor cert required).
But for people who are stuck at their 1-140 waiting to apply for I-485 the only thing this bill helps is increasing the EB quota.
I am a EB-2 applicant (masters) and would strongly support this bill but i don't see how it helps EB-3 applicants as much unless we have the clause for applying for I-485 before cut off date.

Massive IV campaign for Administrative fixes
Dear Members,
Immigration Voice is starting a massive campaign to get administrative relief for our community. We have had several fruitful meeting with the administration in 2007, some of these meetings were scheduled in September, November and then in December. In these meetings, we were able to convince the administration about the implication and hardship due to current broken system. Since Congress has not been able to address our issues in 2006-07, we were successful in creating a case for administrative fixes that would give much needed interim relief to EB community. These meetings helped us start a conversation on possible administrative fixes like 3 year EAD-AP, clearly defining “same or similar” if AC-21 is invoked, and we are hearing favorable feedback.
Due to lack of action on legislative front our community’s patience is running out and we want some relief urgently to get out of probationary status. We are thus starting this nationwide campaign that will help our advocacy efforts and get administration to act quickly. There are several components to this campaign.
1) Support from lawmaker offices: We urge all our members to meet their lawmaker offices and get them to write to The President in support of administrative fixes and urging for an immediate administrative relief. The template of the letter is attached. Letters from lawmaker offices to administration get far more attention as compared to anybody else writing the same letter. The template of the letter is posted below. Please request lawmakers to give you a copy of the letter or lawmakers could copy IV on their letter to The President. Visa allocation chief mentioned in AILA comment that USCIS knows visa usage pattern. Which means that they know pending I 140 for EB1 in pipeline and they also know that average time to get approve new I 140 is X months ( 4 months ) so they know if person files in May 2011 chances are rare that he/she can get GC from 2011 quota.I am not saying is that applicant can't get it but when u look at I 485 complexity and add scrutinity on EB1 I 140 its more than 4 months to get GC from start to finish without any RFE.
That is why they are so confident to release quota now. which may bring date so much forward so that can attract new cases and move back dates to certain point in time. Specially this is how DOS does for all family based CP cases. When they think they have 10k visas coming they move dates to cover 15k out of which 12k may reply on time and they always have control to retrogress dates if they run out of visas.
Big question is how far they want to go and get new cases. If they don't go upto Mid 2008 in next 1 year , Eb2 will loose some visas to EB3 and dates for EB2 will be "C" , if they go with some calculated guess and usage pattern + buffer they should go well into early 2009 with in next 1 year.

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.

It's tough to tell. According to processing times on usics.gov, I-90 takes 3.5 months in Nebraska service center. But the form is supposed to be mailed to Phoenix and I could not find any times for the Phoenix office. Since it's a simple correction, I'm hoping a 2-3 week turnaround time but be prepared for a 3+ month wait. If you need to travel, it's better to get an I-551 stamp in your passport so you can travel regardless.

To be frank, I am in the corporate world as a Director of some crap and I see no ethics.Face the life buddy. Don't talk this ehics shit in this world. Tell me frankly if you did not throw any one under the bus for your future (you don't have to tell, just get it to your thoughts).
And to answer your question, my parents are illeterates, they did not teach me anything (I love them a lot still because they spent lot of money to get me to this position), I learnt a lot by myself with their money.
No wonder we are in this mess. After this economic storm we will be learning in managment classes on the enrons and unethical gurus and how we have in place rules to avoid this crap again. And we will probably not have capitalism as we know...
