I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.
I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.
of all the smooth talk..cmon we all know the one time might power ruled the world.. so its not easy for them to get over with..well for those who dont like i always say..just boycott..but i know lots of them will still give in and take the pain...
the way i see..if indian airlines were upto the task.. we could have direct flights from all major cities in US..but then again how can I simply blame the British govt. for tormenting us..its the Indian govt. who can't sort this..either encourage big businesses to launch international flights with world class service..that's something which we have to wait!

I didn't get the phone# for USCIS compaint dept. But some one(may be ashres11) posted one phone#18003238603 for DHS. I called that number and it turned out Inspector General office. As i reported earlier. He told me to call regular USCIS 800. I said it's useless. He took some note and asked to call this new number 877-246-8253.

Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

One thing i would like to emphasize like others, is background check when you apply for any company in future. Most good companies do a thorough check which includes your credit history. When i joined the company i currently work , I asked for a copy of the report for my reference and it did include that i have a good credit history. Not sure how much companies pay attention to this but yes if they do it could affect your employment chances at some of the top companies.
On the positive side, I strongly believe that the economy will come back on track. Who knows 5-10 years from now your decision may look good. As others advised you should also consider renting out your place... With the population ever increasing, and the land being constant, I always think investment in land will always be a good investment on the long run. At least you have something concrete to show for your money :).
Rest the feeling that you are doing the right thing even though its the hard way is always priceless :)

EB3 india gets only 2803 per year with350 of those going to OW. How did you arrive at the figure.

When I cancelled in Mar-09 , my experience was different. The CS was humble and only persuaded me not to leave. But the cancellation process went smooth.
FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

In order to utilize all visas under given category , NVC will start preparing application and forward to consulate. NVC is rarely wrong in their prediction, sometime they do start processing app in case USCIS fails act on enough cases in last quarter and in case if they have to forward date ahead they want to make sure consulates are ready with file to close.
Since this is June 2007 case , they might be expecting real GC allocation upto April 2007 but they want to keep buffer of 2 months.If person who posted this info is not making april fool joke then PD in last quarter will be defiantly up to June 2007.

Hi,
I do not have medical records to prove that I have taken some of the vaccination that is mandatory for the medical test. However, I do have taken those and my Doctor back in India has those records. Is there a way people know that these records in "any format" / a "specific format" can be faxed or fedexed here and can be used?

Can POJ be only be used for cases that were seperated? Last time, I used the POJ method, the IO told me to talk to the CSR and he refused to give me the status of my case.

in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!
NOT SURE WHY ?? this delay is ??
i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

The IT consulting firm or whatever is willing to hire an experienced employee with more than X years experience for a job requiring more than 5 years experience. As long as this employer does everything by the book, and the prospective employee does everything by the book, what is wrong with this? Note that the prospective employee has still waited for about 5-6 years to get his GC, its not as if they are getting it within a year of applying.
[Note that if the IT firm is taking any money from the prospective employee whatsoever for the labor application, then that is against the labor regulations (at least I think this was part of the new regulations that got rid of labor sub)]
So where is the gaming? Also, assuming that you are saying the employer is taking money and creating artificial jobs then is this thing not a DoL and labor app problem as opposed to a lawsuit problem? I am confused. Please explain.

So some people (and I know around 10 of them) what they are doing is the following:
They got the chance to file their 485 last July , which is pending. They are contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...
This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that.Now you tell me , isn't that unfair

We wasted lot of time, money and effort with this 485 filing for the last 15 days. I am terribly disappointed with the outcome now.
We need to file a lawsuit against USCIS and Dept of State for the loss that has happened to us.

Let all the members who are here in USA for more than 9 years without a green card unite and make this as an ACTION ITEM for IV Core to consider this. Others who like this idea are most welcome to support this.
