RFE was for employers ability to pay .and my friends got same RFE and we has same atorney .employer is financially strong and im sure with good ability to pay .I didnt get notice yet .just got online update .

Dont bother calculating this because by the time you become 65 SS will not be the same as it is today, it can be bankrupt or the retirement age would increase to 75..80 god knows. I dont think anyone can give you a solid answer to this particular question. the calculator does not include your specific situation

My wife had the same issue. We had to type the following letter and attach evidence as follows:
Date Entered to US - Visa Type - Date leaving US I-94 Status Evidence
For the evidence, you need to refer to the copy of the passprt that indicates the stamping and your lawyer must include a letter that states that he has verified all the dates and attach the reference to page number duly attested by the lawyer's office.
Under the I-94 status column, you need to indicate if the I-94 was surrendered at airport or not. If you are not aware, please enter 'do not know'. Visa type was the type of visa used to enter US (my wife travelled on B1, H1 (some 10 times) and most recently on H-4) and now waiting for EAD to resume a new career.
Hopefully that should address it. Apparently, my lawyer has never seen an RFE on I-131. So, he's not sure if that resolves it or not. Case status still indicates an RFE online. Good luck.

Hello everyone. I was following the "IV in the News" Thread and I saw something that may be the reason why the layman thinks IV is an "Indian Organization".
DISCLAIMER:
1) Now b4 everyone jumps down my throat, i want to mention that i KNOW how hard IV core and supporting members have worked to get these articles into the media and I MORE MORE than appreciate that fact.
2) I am not trying to play "seperatist" here (as in Indians v/s Non Indians).
Now for the facts. I was going through the articles one by one and I compiled a list of articles matched up with a list of names. I have posted first names only.

This list includes my name as well. If we observe carefully, almost all these articles have only Indians speaking out in the media. I know that these articles come up on the spot and the media team sometimes has only a few hours to report a candidate to the reporter. Also i know that a lot of these interviews were done by the core memebers themselves on the spot.
All I am saying is that if more such articles are done in future, can we have the Non-Indian members also step up and contact the IV core/media team coz this would truly lend a "multi-cultural" look to IV. The lay-person american does not know what IV is comprised of. With them What u see is what u get. They see Indians in the media and on the news speaking out about the Immigration wait times and they think IV is an Indian organization.
This is a request to both the core team and the non-indian active IV members to please step up and co-ordinate future (such) events so that multi-cultural faces can be seen in the media as well as when we go to meet the Congressmen.
Once again, no disrespect meant to either the core/media team or to the non-indians on this forum. I hope people can see my point. (I am an Indian citizen myself). If efforts in this direction are already being taken, i apologise in advance.

Thanks gcpool for your reply. My question though is that is it pretty much guaranteed that the green card will come through after the 140 clears? I ask because just today the USCIS website updated to say that they sent out a RFE for our 140.
The risk/reward matrix for my situation is as follows:
Stay in USA/green card comes = most assurance of good job and pay.
Go to Canada/green card denied= harder to find job and less pay, but at least not deported.
Go to Canada/green card comes = I'll survive, but there's the possibility that I'll be kicking myself for a long time.
Stay in USA/green card denied = I'll probably jump off a building. :D

I faced the exact same question a few months ago. I came to INSEAD in Aug'07 after taking a leave of absence from my employer. My advice is to keep the door open by trying to keep your process active.

Some of us here are under the grand illusion that
(a) the lawmakes consider relief for skilled immigrants in isolation to be an important enough issue that they will make it a priority
(b) Relief for EB immigrants is totally non-controversial and everybody and his brother will back us.
Both assumptions are dead wrong. If 900 of the biggest companies and universities in america cannot convince congress to make SKIL bill a priority, then you know what a formidable challenge lies ahead of us.
As for EB relief being non-controvesial, I only need give one counter-example : S 1932.
We are all desperate for any relief : I repeat ANY. To think that the core team would be so shortsighted as to only pursue grandiose bills like CIR and not be on the look out for smaller relief measures is naive and severely underestimating their intelligence.

I find it disheartening that a senior member like you would advice someone on foregoing their pleasure trip and donating to IV. Would you be willing to cancel all your pleasure trips/family outings to donate money to IV? If you do, i feel sorry for your family.
Please donate that extra money meant for leisure to IV instead going to Bahama this year.

I read all the three bills and I stand by my statement that Masters in STEM are exempt ONLY from the H-1B cap; not the EB cap. (line 14 on page 2 of H.R. 5630 (http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&docid=f:h5630ih.txt.pdf).) It is only the PhDs who are exempt from the EB cap.
Before you start throwing "smart alecky" comments at others, please let me know where it explicitly says otherwise. Don't show me anything about PhDs; ONLY Masters and EB caps.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
I have seen changing address triggered RFEs in some cases where an applicant moved out of state or even to a new city within the same state. In such cases, RFE was asking for proof of employment in the same or similar role.

I was in DC yesterday and today and it's a life changing experience. It was very well co-ordinated. Thanks to all the people who showed up. Three cheers to nixstor, Arun and the local team who had the difficult tasks of getting permits, co-ordinating with local authorities and everything went according to plan..Since I had lobby meetings in the PM had to leave early. They still had pletny of work to do. Their hard work paid off...

Attorney emailed me this morning all our Receipt Notices for our I-485/I-765/I-131. All numbers start with WAC. Receipt Number of I-485 is the same number as Transfer Notice.

So you apply about 4 months in advance? Are you then not losing about 3 months of your previous validity due to this practice?

If your new validity date starts before the current one expires then yes you might lose the time depending on how fast your EAD was approved.
In my experience there has been no consistency in the issuance of the validity date in the past. I have received cards where the new validity date has been the day after my current EAD expired thereby me not losing any time and there have been times when I have lost time due to new validity date being prior to my current one expiring.
As per USCIS rules you can apply for renewal 120 days before your current one expires and not before that. Remember you can also apply for renewal a day before or even after expiry, its just that you cannot work as long as you do not have a valid EAD(or other work permit like H1B, L1 etc).
So as long as you are not at the risk of losing your job due to no EAD in hand I guess you can apply anytime once your 120 day window kicks in.
PS:Above is just my understanding of the system and should not be taken as legal advise. For any clarifications please consult your attorney.
