Many asked you about H1B employees...but I have a different question for you...
Do you place consultants (and they are not your employees) thru vendor to the client place ? Like just forwarding resume to vendor (not to client) and charge every hour say 5-20$ per hour as long as the consultant is on the project for just forwarding the resume ? I know many desi employers do so I wanted to ask you.

I like your optimistic attitude but unfortunately I don�t share it because of past and current behavior of USCIS, like for instance how they willfully disregarded the 180 day name check memo. Do you really believe them when they say name check will be cleared in 2009, just like the current name check memo the fbi name check clearance will be thrown in a dustbin. If by a miracle name check is solved they will come up with some other check delay for example IBIS name check delay. the bottom line is if there is a will there will be a way, USCIS has no will what so ever to help us. Good luck to everyone but just build a reservoir of patience because if you have hope on USCIS you will pay dearly.

Based on available numbers, EB3 India / China will see rapid movement in dates April 09 Visa Bulletin onwards.

this is also assuming that you have filed for your 485. you cannot apply portability with:
approved labor + approved I140
you can only move to another employer with:
approved labor + approved I140 + pending 485

What is Ron basing his prediction on... I am not sure the trend says so... Can anyone please share his logic?
2 months before, IV has learned from CA/VO at the State Dept that 80-85% of all the visa numbers have been allocated for the fiscal year. I am sure that the actual usage by now is probably more than the 85%. If I am not mistaken, DOS considered 95% utilization as best in the past. It seems to me that they want to get close to the 100%. If you look at the last few bulletins, the cut off dates moved by one month and not by leaps and bounds. Clearly there was demand. I can see EB-2 I & C with PD's of 2002 getting approvals. The demand for EB-2 I & C still exists. DOS just gave USCIS an opportunity to USCIS to utilize the visa numbers. We all know that there is no such thing called FIFO with CIS. I have said this before and will say again one more time.
In the last 2 months, Some one with a PD of Jan 06 might get approved and some one with Jun 02 will be sulking. Just because EB-2 I & C dates have moved to 06 for a brief time does not mean that EB-3 I & C are the only ones that will be left sulking for ever. EB-2 I & C will join the lines in no time. The comparative pain & wait time for EB-3 I & C is more, but what difference does it make if it takes 6 years vs 10 years. Any solutions or thoughts to our issues that are designed entirely on a EB category basis, IMO are not good.

Sorry, just trying to lighten you up...relax dude just wait it out you should be alright. the key is to turn in as much information as possible when required. and submit the original copies wherever you can.

also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.
Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview.Some of them are sent back.Now you can't find employer to transfer your H1 immediately.Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter.Now if you don't have a job you can't transfer your H1 to anybody.
Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

You can call to Customer service center can find out your Name check is cleared or not?.
I did that and was able to get the deatils of the name check, USCIS sent to verify name check on 9/28/2007 and not yet cleared, I filed 485 on July 02, 2007. My case details are below.
Labor cleared Feb '2007 - EB3
I 140 Approved June '2007 ( Ported Priority date: Jan 2001)
I 485 - Pending filed july 02, 2007

USCIS is already aware of this. They have been notified through AILA and our letters are also working. IV has also been pushing for more broader AC21 regulations for a few months now.
Our request from IV is to keep sending the letters. Please send letters in thousands - not like 50 to 60 letters.
Everyone must take initiative and push other members. It is a very importasnt campaign.
It is very much possible that a lot of you may be a victim of AC21 denials. It is your call.
Please take responsibility and everyone must come forward and bring others also into this campaign.

Is this just the speculation or any other indications are received?? any idea? I am afraid that what will happen to people who already have used AC21 by following what currently exists???????

SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?
We do not need any Congress approval for that Right?
If so can we explore this option??
I agree with you. Why we don`t explore this option ???? USCIS make so many rule by itself then why they don`t make this rule to file 485 while PD is not current without going in Senate. Like they start premium processing of I-140. They make this rule without any bill in US Senate. correct me if I am wrong
