    I heard some one telling me that there is a max limit of 5000 mts per month which includes local, long distance and international.

    Is it true or just a rumor ?

    As per my phone and chat conversation with Vonage is that it's a rumor, there is no limit at all, you can call as long as you want....

    I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.

    This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.

    Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

    All employees are protected by employment discrimination laws. Once H1Bs are hired. They are protected as well.

    Well, all the jobs you mentioned in your message now falls in Zone 4 i.e. Eb3.
    Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.

    Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
    The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
    Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

    Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.

    You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????

    Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!

    And your questions about returning items to the store; you prove again that your a dishonest man! No, you cannot return a used item. It is wrong. Nothing legal about it. Who told you it is legal??? Now you may go back to the store and pretend like you didn't use it, or that the item is defective, and pass it off, but that's YOU!!!! In your own little dishonest mind everything that is in normal circumstances considered wrong is perfectly fine! You and your buddies here like "kumar1", "leo2606", think that it is fine to return used merchandise. You are all a bunch of dishonest people who didn't learn about right and wrong while growing up. Its not too late, go learn!

    if someone did give an option and you dont like it, why dont u give an alternative option rather than venting out uour anger.
    No one is asking you how u feel or what is ethical and non-ethical..It seems that you are such an ethical guy who has not used a product and went ahead and returned it back to the store..If foreclosing is illegal let me know.. People here are giving pros and cons of doing a foreclosure.. i dont know if you own a house or not, and if you do.. dont know if you are having a perm job or a contract..I know so many people who own house and now they are in a fix because of housing market..I am not like other people who have already foreclosed..and btw.. why to blame the people and not the banks.. if i can own a house and pay mortgage which is quite same as a rent, i will better own a house and sell it after couple of years.. what is harm in that.. i may have mentioned about making profit by owning a house.. but i am not looking at becoming rich by living in a house for 2/3 years..Sledge_hammer and you are complaining all the way in the thread about people who are foreclosing or foreclosed.. but not spent your valuable time in letting people, reading the thread, know what are pros and cons of foreclosure and how it can affect 485..

    Hi Folks,

    In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.

    Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?

    From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)

    Any comments ?

    You definitely sound like my mother , who gets scared by the news that gets published in telugu news papers about gas station shootings in USA. Otherday she asked me not to goto "that gas station in Kentucky" .. I live in CA.

    There is no shame in protesting injustice. Nobody who sent flowers is foolish enough to think that they will get their GC just because they sent flowers.

    Can you please explain what is the real problem of USCIS?

    You have to be kidding! Here people are crying to get there EAD's extended and you think the Govt will give us citizenship???

    Please i suggest everyone to wake up and smell the coffee/chai.

    If you think giving us citizenship will be easy becoz it will prop up their vote bank think again coz it will never happen. Imagine the headlines which says recession time 10M americans out of job, foreign workers to get citizenship LMAO!

    Forget this ever happening in a recession time and not much of a chance in the boom time either, see how the Anti-Immi's will eat everyone up for this ridiculous suggestion, please remember we're nothing in the larger scheme of things for the decision making people, we need to understand our limitation and strengths and play by them, IV does a decent job of that.
    Do think rationally before coming up with ridiculous ideas like giving senators free pizza or asking for-direct citizenship. lol.

    I strongly support this thread and the message. Lets make an action plan how to pursue this.

    Devils_Advocate: I know your type. But you must also understand that unless the line in front of you is cleared, you and I will go down the drain. You are talking about EAD. I dont even have that, yet I support this.

    I got an RFE asking for my "Education Board Certificate". I was told that it is 10th or 12th pass certificate. Its been a long long time since i passed. Does anyone know or has any experience on getting a duplicate from CBSE Delhi?

    Is there any workaround, i have US masters and they still need a 10/12th pass certificate.

    All I 94 - does this mean all the I 94's you ever had or the I 94 that currently is in your possession.
    I do not have copies of all the I 94's that were issued to me since my stay in US .. any body any thoughts?

    Be ready with the following supporting documents. My attorney asked the following:
    1. Personal Details -
    (Travel Plans in the next 3 months, Moving Plans in the next 6 months, Contact Information, Passport and I-94 info, Employment Hisotry - Last 5 years+ Last job ouside US, Residence History - Last 5 years + last residence outside US, LC, I-140, EAD and details, and a few other questions, etc)
    2. Passport copies- all pages, current, all old.
    3. All I-20, I-94, I-797, LC, I-140 copies

    Multiple-Year Single EAD-AP Card Reportedly Limited to Visa Regrogression 485 Filers

    Some more details have been released on Mr. Aytes' statement on this plan. Reportedly, such multiple year card may be issued only to those who suffer the visa number retrogression. In other words, those 485 filers who will experience delays in 485 applications who do not suffer from the visa number retrogression but from the USCIS delays including namechecks are not likely to benefit from the upcoming multi-year card issuance.

    Hi,

    I was scheduled to travel outside US this summer for about 3 months. Then dates move past my PD and I have to apply for 485 in june. I have discussed these with the lawyer and want to confirm what she is telling me:

    1) I have to be in the country to apply for 485.

    2) FP notice will likely arrive in 3-4 weeks. But we have 84 days to reschedule this if needed.

    3) I was not planning on applying for EAD/AP at this time. However, she says that if I leave the country on H1, and 485 is approved while I am out of the country (HIGHLY unlikely but still possible), then I cannot come back into the country unless I have an AP. (This is the point that I mainly need clarification on!)

    4) If I DO apply for EAD/AP then I cannot leave the country until they are approved.

    5) Finally she cannot give me a timeline for how long EAD/AP would take. The service centers processing times show that they are currently processing Jan cases. Which means at least 4 months wait after applying for EAD/AP.

    Does any one know if any of the first four points are wrong. If so, what is your knowledge about the point that is wrong. Also, does anyone have any idea on point 5 (i.e. how long it is taking for EAD and/or AP these days).

    If you have any information, please respond ASAP, so that I can determine the best course of action before filing for 485.

    1. Country cap for visa numbers
    2. Visa numbers wasted by USCIS by their inefficiency

    EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.

    If you want your GC faster, work with IV for country cap removal and recapture.

    Have you donated a single dime for IV's cause ?We always find it easy to go against fellow immigrants than fighting the injustice at root.

    My understanding is this is a forum where we can express our thoughts without any fear or prejudice.

    I agree with you that the main reason for the GC delay is the two causes you have mentioned. The Country cap is based on the current law (I am not saying the law is good). However along with the main causes for the delay the fraudulent uses of EB1 visa #s are also causing extra delay. Thus along with the effort to remove the main cause of delay we should work on the other cause of delays too.

    I am also agreeing that as per the current law the L1A - Senior Level Manager can get their GC processed as EB1 and get GC within six months. I agree that this is the current law.

    My main concern is the misuse of this law. People who should not get L1A visa are getting L1A using fraud and taking the EB1 visas which otherwise as per law would have trickled down to EB2.

    You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".

    You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.

    Regarding donating to IV think I am not accountable to you. Please note that this is a forum where everyone can express their views without attacking each other personally.
