Last time Hillary introduced a bill for giving gc to spouses of gc persons. They rejected because republicans think it will add hundreds of thousands new immigrants. Basically they do not want to add new numbers. Best time is at the time CIR lobbying can be done

I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. To bring updates evey week or every month , we might need to put an advt for a accountant for IV, unless you can wait for yearly updates.
huh ?? what's wrong with having update to date count on IV contribution and balance ? If people are funding IV , then IV can post where that money is being spent. IV is non-profit organization.. right ?

Looks like it is the photos. I got the RFE after opening a Service Request and they have asked for photos. Morons. They could have made it clear in the instructions to send photos.
It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.
So, better send the pictures if you are planning to e-file.
I have sent the photos and now have to wait for another 45 days. Hopefully a smart guy who knows what he is doing will process it this time.

It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.

Once you leave your shores and come to another country, peeople from every nationality are same. Indians, British, Nepalese, Pakistanis etc...... There must not be concerns about names that sound Indian.....
Indian names are very nice names, kinda difficult for westerners to pronounce but whats wrong in an Indian name???
Indians also have names like John, James, Mary etc... which sound western. Whats wrong with Aman ?? The name is nice. Easy to pronounce.

I received RFE on my 140 on nov 15th. I came to know about this when i checked the status online. It says on Nov 15th we mailed you a notice requesting further evidence . I-140 Receipt date is dec 11 2006. I do not yet know what the RFE is about. How many days does it take for the RFE to arrive normally ??

Krishna_brc is correct. H1 B alien can be on medical leave, sick leave and can be unpaid during that period.
Get a letter from your employer saying they are granting you a personal unpaid vacation as per your request(which can be done using a pre-dated letter to them). Make sure you are getting your medical coverage from them(if you have it through them). Provide that and an explanation that you are taking personal time off due to health etc/stress. Hopefully that is flies with the USCIS.
Per law you are can get vacation for which the company has to pay you or you can also avail of unpaid vacation.

Today I received RFE for my H1 Extension.
I received only one RFE which is obtaining contract documents from the chain .
Here is my situation.
I work for Client A for whom Company B does the project work. I was contracted through Company C who is the prime vendor for Company B.
Here is the chain.. My Company --> Company C --> Company B --> Client A.
RFE states that my company need to provide contract documents within the entire chain which is highly unlikely they can obtain.
Company B and Company C can only provide letters to affirm that that I work for Client A. Will this be enough or does it need to be only a Contract document?
Below are my questions
==================

If USCIS was a tv company here is what would happen:
A person would purchase the tv and after the warranty expires within 3 years, the person will need to apply for extended warranty at a designated USCIS tv store before he can use the TV again.
Once the owner 'applies' to purchase warranty, the USCIS can choose to hand out a yellow form for further administrative processing, this can take anywhere from 2 weeks to 4 months, within which time , the owner is not allowed to switch on the TV. Once the warranty is approved and purchased, owner will need to repeat this process every other year.

Hello Everyone,
Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

2. Or call the DOL and inform all...and he will be in soup.
Put everything in e mail or certified mail and pass all those information to DOL and move on.
You dont have to bother anything else.

I did not follow the I-485 filing debate; it was sickening. I made a one time contribution. I don't think I am included in the 220 count. I think there are very few members who have made a one time payment recently and are not included in 220.
I think, the count 220 includes only recurring payments that started this month. Some persons paid before this count started.
The only useful thing we can do is to work on contributions. It is hard to figure out reasons why persons are not paying. I think it will be useful if we guess all possible reasons and work on all of them.
We should not insult any non-paying member or anyone for that matter. I still want to know

The instruction reads as

USCIS does not mention anywhere that you either SHOULD or SHOULD NOT send photos.
So a better assumption can be "send photos".

The second bill (HR 5634) says that people with PhD from US universities are cap-exempt from EB. So it means some quota will be freed up from EB1 and also from Eb2-NIW.
