Thanks L1fraud guy for bringing up the details to complain. I have contacted the local office and proceeding with the process as outlined by the ICE officer. I agree with you and other members on this thread who say this fraud has to be stopped before it becomes uncontrollable.

Please keep writing. As many posters already pointed out - economy is getting worse and changing job may become a necessity to many of us. We cannot afford to jeopardize our green card process - if our old employer withdraws I140. Our only way is to raise and get enough attention to this issue so something is done quickly before it becomes a norm.

Friends,
Finally we got our receipt numbers today from the Check Images. Our Application reached USCIS on 07/03 by USPS Mail. Don't know who signed it. Have been waiting for it patiently. All our receipt numbers start with SRC so from Texas. My I140 was approved form Texas and there was an LUD on the I140 on 07/28.
All the best for whom ever is waiting for the receipt numbers. You guys should get it pretty soon.

She may have been nice, but she did not give you correct information. I don't know where you "spoke to a very nice IO", but if it is the phone line, they are outsourced phone operators who are poorly trained and do not have access to the information that IO's have.
FBI name check comes back in 2 weeks at the most, if not then it could take 2 months to 5 years or so.

I have my 140 approved ,in order to apply for I485 do I need stamped H1 visa in my passport?
I dont have my H1 stamped since 2003 ,I have I 94 valid until oct.2007.
then accordingly we can go to canda or my country to get it stamped the earliest,if it is mandatory.

"The idea of having a leadership bill ... has been abandoned," he said last week. His panel will begin marking up immigration legislation March 2. A chairman's mark expected to be introduced this week will resemble the mark Specter circulated last year, which borrows components from various immigration proposals. It included the border security provisions in the plan introduced by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., as well as the guestworker plan introduced by Sens. I personally know many who had been "working in H1B" for more than 14 years.
Not everybody gives more weightage for their "immigration plan" than some personal and career interests. If you are really truthful to USCIS about your intentions, and you keep doing what you want to do with your career and life, it is in-fact very possible that you will be found without a GC even after 10 years working in USA, if your are from India.
An approved I-140 doesnt make you "automatically" qualified for an I-485. You dont file 485, if you dont "intent" to continue with that specific employment, even after I-140 approval.
7Years???? No..... you can extend your H1 beyond 6 years as many times as you want if you meet some conditions as per AC21. So it is possible for you to be in H1B for 100 years.
10years tax payed???? Yes because of the other reasons I mentioned. Also I know many who are still in que after 14 years paying taxes.

Hmmm - not sure because, if the job requires that someone must have security clearance - the job must clearly mention that someone with security clearance is needed. What is the point in hiring a citizen without security clearance (unless they want you to get clearance aftewr hiring)

May be, an email to the HR of the company, with supporting links that does not encourage such posting legally will educate / prevent such posting in future. I hate to play "who winks first" game with teleblend. They told that they would come up with similar india plan but not providing any details.
May be now I should switch to vonage or Lingo. One factor in favor of vonage is: I get two months free with referral and one year contract rather than 2 years with Lingo.
As per one my close friend, lingo CS is not very good. Vonage is still better than Lingo.
However here is my question.
The acutal cost of Vonage with unlimited india calling is $31 - $32 per month due to taxes, misc charges etc.
WHAT would be ACTUAL COST OF LINGO per month? any approximation?

I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.
This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.
Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?

It is illegal... On I-9 it clearly says that an employer can not deny employment because of an expiry date on a valid work authorization document. This makes sense, since the employer does not have any authority to check for this candidate's ability to renew the authorization, neither the candidate is obligated to share that information. Per DHS & DOL once you have valid EAD, you are good to go! I am curious though who should be responsible for educating these employers!:confused:
Good to know. As to who should be responsible to educate the employers....there's no doubt in my mind ! It should be us - prospective employees - applying for job. If we don't raise the issue, then who else will do it for us !!!
People can follow a polite plan of action for such questions...
- Be aware of the law
- Be prepared to respond back politely - giving the bare minimum info that would be sufficient
- Point politely to the law during interviews if pressed hard to divulge details.
- If you see the interview going no where, without having to divulge the details, then at that point its a matter of consience....If you had EAD with enough validity, and you think/guess, that the employer is only concerned with people with soon expiring EADs, and if you want the job bad, then may be you can give it a shot and divulge your details. But as much as possible one should shirk the issue politely until you pass the interview process and they are ready to hire... Divulging at that point is beneficial since you know if you get rejected at the point, it was purely because of EAD issue and can take them for a task. If you divulged too early then they could hide behind other reasons for not hiring you.....(unless the employer is CapitolOne, and the HR guy sends out an email blatantly providing proof of discrimination and leaving themselves at your mercy to be sued :) )
Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?

It is illegal... On I-9 it clearly says that an employer can not deny employment because of an expiry date on a valid work authorization document. This makes sense, since the employer does not have any authority to check for this candidate's ability to renew the authorization, neither the candidate is obligated to share that information. Per DHS & DOL once you have valid EAD, you are good to go! I am curious though who should be responsible for educating these employers!:confused:
Good to know. As to who should be responsible to educate the employers....there's no doubt in my mind ! It should be us - prospective employees - applying for job. If we don't raise the issue, then who else will do it for us !!!
People can follow a polite plan of action for such questions...
- Be aware of the law
- Be prepared to respond back politely - giving the bare minimum info that would be sufficient
- Point politely to the law during interviews if pressed hard to divulge details.
- If you see the interview going no where, without having to divulge the details, then at that point its a matter of consience....If you had EAD with enough validity, and you think/guess, that the employer is only concerned with people with soon expiring EADs, and if you want the job bad, then may be you can give it a shot and divulge your details. But as much as possible one should shirk the issue politely until you pass the interview process and they are ready to hire... Divulging at that point is beneficial since you know if you get rejected at the point, it was purely because of EAD issue and can take them for a task. If you divulged too early then they could hide behind other reasons for not hiring you.....(unless the employer is CapitolOne, and the HR guy sends out an email blatantly providing proof of discrimination and leaving themselves at your mercy to be sued :) )

Where did I say that american's gave better advice than desis. I was just trying to compare mentality of two diff community for a same situation.
I m not asking for personal opinion as to how u feel when someone foreclose.I m asking for an advice as to what r the consequences
It was greedy people like you who brought us into this mess. Didnt you think twice before making this huge investment. There are lots of websites/sources saying if you are not going to live in that house for at least five years, Do not buy it.
Every one thought they can make money because the house price is going go up all the time. But only the other guys are 'Stupid'.
Well, when you are going for foreclose it will affect your credit history for very long time. Even it will reset your credit card rate to default APR around 32-38%. I am not sure about the other consequences.
