An overwhelming majority support 485 so going by your own reasoning IV might lose more members by not supporting 485. Dont try to act too smart. Lets just support whatever decision IV core takes and go with it.
I made a one time contribution myself but I have a feeling that IV is going away from the goal of increasing EB visas and just focusing on the 485 filing.Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.

Degree may be from anywhere in world as long as the institute is accredited by local accredeting body. I checked U21 and really could not understand its legal status. It looks like a group of universities under one umbrella body. As long as you have a degree from a accredited university, you are fine.
Once again, you will need a Masters degree , a diploma will mostly not work (but check with attorney)

Dear Sir,
I have 12 years of experience in IT industry and I have my I 140 approved in EB3 category.
Since I have only 3 years degree from India, I can't file the GC in EB2 category. So I have decided to do postgraduate diploma in IT management from Universitas 21 (http://www.universitas21.com/about.html). I found they are quality education provider but not aacsb accredited. So in that case after completing diploma in postgraduate can I upgrade my GC to EB2 category?
At present I am not worried about the position required for EB 2 filing because I am an architect and can easily switch to different company and get decent salary. But what I realized only job and salary won't help until I have proper education.
So it is my request to appropriately guide me aboud the eudcation perspective whether I am on right path or not. Also is diploma is sufficient or I need to masters too?

My 6th year H1B is expiring on April 28, 2008. I applied labor through PERM on October 2, 2007. I got the audit letter on December 3, 07. This audit letter does not state anything about the issue of the audit letter. However, the sentence �The job duties and/ or requirements are beyond those defined for the job by SOC/ O*Net code an Occupation Title provided by the State Workforce Agency� is highlighted in this letter. The letter also request for Business Necessity Letter and Recruitment Report. My case is the EB2 case for a Project Manager position with a minimum of 2 years working experience. A couple of programs and knowledge in the field are also required for this position. At the recruitment times, there are no applicants applied to this position. The company has approximately 16 employees including me.
I�m very confused and not sure what to do because my lawyer refused to answer any question. In my case that the Labor Certification is still pending (under audit) and my H1B is expiring in April, I wonder if I should start taking vacation now or go to work in another country for approximately 6-7 months and come back later to use the rest of my H1B until October 2, 08 to meet 365 days period? After October 2, 08, I can then start filing the H1B Extension for 1 year. Or should I wait until my I-140 approved and come back around October 2, 08 and do the H1B Extension for another 3 years? Or should I stay in US until April, 08 and take vacation until October, 08 and then comeback around October, 08 to file H1B extension? Also, do I still have to be employ full time with my current employer during this whole period? Can the job only be part time? EB2 category is meant for minimum 5 years experience and whne your title is having the word "manager" it becomes more stricter definition.... In my opinion EB2 is always about minimum 5 years experience and that is where your lawyer screwed you. And yes the reason highlighted in the audit letter is real reason and it is direct indication of this conflict.

Do not forget that the nurses / ph Therapist category swallows bunch of or all of EB3 visa numbers. This category is always current and they can make this EB3 to get stuck in April 22'01 for years.
Unfortunately most of the nurses also come from India I beleive. Some come south africa and phillipines. Do we have any data on this anywhere?

then these cases are either (2nd China/India, 3rd, and other workers)??
considering 140,000 visa numbers available, and other catagories being current, only portions these retro cases will get visa numbers by this year..

Thanks for sharing your experiences. Is LLC corp employer eligible to do H-1 transfer? I have an American citizen friend who has a LLC corp and work as an independent contractor. Can he file for my H-1 transfer and can I work for him?
His annual income is about 150 to 200K. I think he takes about 100K as salary and rest as company profit.
I have my 140 approved and 485 pending (>180 days).
Any potential risks with this approach?

Hi guyz,
Bit of addtional information that might be just what was needed to make final call.
I spoke to Fragomen, my Law firm, and they informed me that priority date for filing I 45 (Green Card last stage) is current for Labor applications (EB3) filed in April 2001 and unless something dramatic happens again, things will move at its own pace.
My Labor (in EB3) was filed in March 2003. Estimated time to get GC might be anywhere between 1 year to ... who knows....
I am leaning towards resigning and start it fresh.. wherever...even If it is US fresh H1 will always be there.

A reduced course load for less than half time is only acceptable for defined medical reasons (214.2(f)(6)(iii)(B)) or for the final term of study if the school determines that fewer courses are needed to complete the course of study (214.2(f)(6)(iii)(C)).

As other members have advised, until 180 days+, maintain good relationship with your current employer as if you are going to be with them for ever (don't even give an inkling that you might be planning to leave). After 180 days you may leave, but you will have to find a new employer who is willing to hire you on permanent basis upon getting you GC for same/similar job as in the LC. What you do until your GC is approved (contract job with this employer or something else) is a different matter. Those employments can be on EAD, H1, temp/permanent, etc.

I have not been laid off and I don't have problems finding jobs; in fact my company has asked me to search for one more person with a background similar to mine. However I have been limited by the requirements of AC21. I was toying with the idea of leaving the country; but cannot sell my primary residence and might have problems obtaining a visitor visa for re-entry (to close on the house). I was seriously considering investing in some more real estate; but am holding back due to the random AC21 denials. I want to start my own business since I finally got my EAD this year - but with all the uncertainity of AC21 case approvals, I am not willing to put personal resources into a business in this country. Currently I am working on starting a free workshop for investment in my community - which will stop if my I-485 is denied in case my former employer revokes my I-140 (and yes; I did send in the letters for AC21). I have registered my dog with therapy international and volunteer my time for various causes (cabin repair, trail maintenance, public education) and donate regularly to the fire and police - all of these will take a hit if I have to leave.
I wonder what the reporter will conclude if he/she talks to immigrants who have lost jobs and have trouble finding new projects........
