What is the normal time frame for receiving AP papers?
My wife's AP papers were mailed on 17th Sep but we are still waiting for them.
Are they sent to applicants home or attorney's office?
Thanks in advance.
485_spouse
If your attorney had filled A G28 right. He will get them. Ususally they come in 3 days or so after they said they mailed it.

I have mentioned twice already about the amateurish concept of red/green dots.
Masterminds are yet to give a logic behind its creation.
Please ignore this red/green s***. We are adults here talking immigration.

By the way, how do you tell a soft LUD from a "hard" LUD?
Soft LUD: only last Update Date changes w/o a change in status
Hard LUD: last Update Date + case status, both change

Can't we have the website admin clean up and get rid of old items (action items, news etc) cluttering the main page of IV and put this in bold? Some of the most important and interesting action items (FOIA request, this one etc) are buried in forum threads and need to be bumped up.

I don't know how much time you took to complete AMIE.
Longer is better in this case.
I finished my AMIE in three years and I am in trouble.
If you took four or more, then you are lucky.
May be you can request a letter from IE, Calcutta mentioning the timeframe you took to finish AMIE.
That helps to support AMIE is a four years degree.
Regarding MTR, may be you can tell your attorney that similar AMIE applicants got I-140 approvals and your bad luch that it got stuck.
If your ed eval says you have bachelors, then you can tell your attorney that you have the qualification and you want try one more time.
My personal recommendation is go for another new labor with EB3 and draft it accoring to your qualifications.
Once the I-140 is rejected, then it is a bad remark.
All next I-140's will be linked and tracked. So it is difficult to convince USCIS that you have bachelors. Even though you go for MTR, you can buy time and it is hard to get positive results from USCIS. This is all my guess.
It is always better to go for EB3 new labor as you have some time.
Thanks and all the best.
Here are the details of my case:
Hi All
Please I need some help urgently!!! Here is what I am going through My I-140 got denied on Aug 28, 2008.
My education is 10+2, 3 years diploma in engineering, AMIE in Mechanical Engineering and 2 years PGDIE (Post Graduate Diploma in Industrial Engineering). I am working with the largest enterprise software company and hence a big law firm as well. I have total 15 years of experience (12 years after AMIE, 10 years after PGDIE).
In my labor its clearly stated that the bachelor equivalent is needed.
Labor Priority date: 5/10/2007
8/7/2007 I-140 petition filed for EB2.
8/7/2007 Adjustment of Status applications filed.
8/7/2007 EAD application filed.
8/7/2007 Advance Parole application filed.
9/25/2007 USCIS Receipt Notice received.
10/23/2007 EAD approved and valid till Oct 2008.
6/20/2008 EAD renewal application filed.
Not sure when my lawyer got request for REF. However, I was asked to get more detailed information like transcripts / mark sheets with regards to AMIE. I submitted whatever my lawyer asked for.
In the mean while, my wife got a job. I asked my lawyer if its okay for my wife to start working and they said yes she can and there will not be any issue her visa status. My wife was on H 4.
7/1/2008 RFE Submitted
08/28/2008 I-140 / I-485 got denied
I still have valid H1.
I-94 Expiration: 4/10/2009
Estimated Final I-94 Expiration: 11/25/2011
My questions are
Is there a known case of guy with AMIE got it through EB2? If so what needs to be done?
How do I convince my attorney that we should go ahead and file the MTR.
Please help!!!
Thanks

JSB,
You may be right. But with your logic all these talk about opening an SR, getting an infopass and blah blah is not right then. We have polls here on what worked....that's what i was telling it is too much of a coincidence. Opening an SR won't make a sick IO healthy and come back to work..taking an infopass won't bring a dropped out file back in the pile...talking to senators and congressman are useless anyways....
So bottomline is all this talk about what works or not is a pure guess and nothing else....USCIS has always been a black box and will always be..

Do you have WAC or LIN numbers?
Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.
All our cases show this status now.
Any idea what happens next?
Current Status: This case is now pending at the office to which it was transferred. The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.
I know a fellow countryman of mine who left but did not go back home. He is now in the UK on the HSMP (Highly Skilled Migrant Program). What information do you need? I may have to contact him for his approval, so let me know.

I am in similar situation. Originally applied to NSC, got Xfr'd to CSC. Now CSC after processing EAD/AP Xfr'd my I-485 back to NSC.
ANyone in similar situation has rcvd Finger printing notices? I assume Aug 17th filers at NSC are ahead of us?
Also, i received the EADs in mail, but haven't received the AP even though online status reads AP mailed a week back. Any idea how long it takes to get AP after it online status reads approved?
Please share any information.

Hi,
I'm a bachelor and applied for 485 in July '07. I got my EAD, AP, FP etc. I'm using my H1B visa to work (not my EAD).
I'm currently working for Company X that filed by 485. If I do an H1B transfer and work full time for my client, Company Y, then after getting married and my priority date becoming current, who has to file my spouse's 485 - Company X, Company Y or can I go to any independent lawyer that is not working for Company X or Y?
Is the 485 application linked to the company that filed my labor and 140?
Please let me know.
Thanks,
greencardfever

The words "unlawful misrepresentation" might be a big concern. Get in touch with an attorney asap. Either you gave a wrong answer in some document or your H1 filer did.

Well - these people get VIP treatment in prison - believe me - they get good food, drinks, entertainment, cell phones, cable tv, reading room and other things. They wont keep VIPs along with pickpockets and robbers.
Most of the VIP frauds actually continue their business operations or start new ventures when in jail and sometimes form new partnerships with like minded VIP frauds who are also in the same prison.
It is a haven for them.
After all the heat goes down and after few years they are released, no one cares - they may either settle in a beach house or continue with another fraud company or maybe enter politics.

First thing is why members have found that title is scary? I dont think it is scary......it might attract your attention. Probably most of people who got scared might be using EAD or are considering using it.

I think using AC21 does not imply that 485 will be denied.

In a hypothetical situation lets assume it is denied we need to find why it is being denied? One can always switch to h1b (with previous employer - should be valid when AOS is denied) by going to home country and getting h1b stamp on passport but even before you have to do it you can appeal in court and you will be able to stay here.

I was discussing the same issue today with Ron Gotcher ( you can find it on his website as I have the same userid) and he said unless you are inadmissible or commit a fraud or have broken immigration law in past AOS is not denied. Just in case if you have done any of the above three things then your AOS can be denied and you can not even get any type of non immigrant visa..........

For using AC21 just make sure that:

140 is approved

Your GC sponsor will not revoke 140

Your GC job description and new EAD job description are same or similar (title does not matter)

ONet code for both the jobs match.

If you ensure the above things then there is no issue using EAD for a job after 180 day of filing 485.

Hope this helps and people who got scared does not gives me red dots for speaking aloud.

Support IV and make the difference for yourself and everyone else in the immigrant community.
appealing/motion to reopen doesn't allow you to stay in USA.
If employer revokes 140 then no basis for getting h-1b extensions.

I think Acceptance agents are different than the IRS authorized banks. Agents would merely accept W-7 forms... Where as bank would accept W-7 froms to open a chacking a/c or savvings a/c. More light on acceptance agents would be appreciated.

I know this topic has been discussed in other threads as well and those threads got buried over the Period of time but this is getting beyond limit now - let me know if anyone has any good idea or if we can do anything together......
My PD is EB3 Mar 2005 and my 140 is applied in EB3 May 2007. at NSC (Nebraska) Its been 13 months and no signs of movement and no one is helping . Here what I did on a personal level and here is what i heard.
a) Contacted USCIS - they said contact employer/lawyer because they are the beneficiary.
b) Contacted Lawyer - they said 'Pls wait for some more time' & then ask employer.
c) Contacted Employer - they said that we can't push lawyers unless your case is passed 2 months from Processing Date update.
d) Contacted Local Congressman - Told them that the Processing Date update is a farce and USCIS (NSC) moves them back n forth just to save their Face. This is really unfair for a certain category of peoples. They took my case no. and inquired and then said that since you have a parallel H1B and a job - we would wait. If your existence in US comes on the Line then we will Jump in and help you. We are sorry but we can't really expedite unless a emergency comes.
Now tell me folks what other options we all have - NSC is just messing with EB3 140. Whatever is the workload this can not happen. Do we still have some options to work on (apart from sitting idle and pray) ?
My PD is EB3 Nov 2004 and my 140 is applied in EB3 1st May 2007 and still now no updates..just waiting..waiting waiting..

Seems that senators had only 1 hour to look through the 115 page manager amendment and lot of stuff was sneaked in that would not have passed otherwise... I wonder how it would stand the scrutiny of the conference. I am puzzled as to why they had to sneak-in legal immigration provisions in the last minute.... Is it that controversial ?
Manager's amend. are those amend. which are non-controversial and have been agreed to by majority bi-partisan senators. People who are calling the manager's provision as "sneaky," etc are against any immigration. This is another pretext to beat the dead horse.
It seems that you missed out on the exciting live action in the Senate.
Senate just didn't have time to discuss all the amendments and provision. This issue about who will have how many amendments was a problem issue from the start. After the motion for cloture was filed they had to end the never ending discussion and pass the bill. CIR bill was 641 page bill, addying 115 more pages is roughly 20% more. Also you need to look at the number of amendments not just the number of pages.

Guys as a RULE. Pls contact the Core members before contacting ANYONE no matter HOW pro-immigrant we think he may be. Let that be a policy of sorts. Just talk to ANY one core member and discuss it before u take any action. Media exposure is a double edged sword so let us please be careful as to who we contact.
Guys did you notice , advice from eb3_nepa. I just wanted to repeat it for all. That's a good advise , I think.

Thanks for your input guys!
My lawyer (from the new company) is suggesting I go to the local airport to have it corrected. I plan to call there and see if they can handle it.
Else I plan to go once again to the local USCIS office and this time ask for a correction.

I appreciate your response even if the guy is not a donor. Great job.
I thought about that for a minute too. This guy has joined on Dec 06, don't know if he made any financial contribution, don't know if he acted upon any action items IV core requested us to do (hopefully he did)
But IV core stepped in to help this guy, that shows the commitment of the leadership team to help everyone.
You guys rock!

Exactly, you have to be mature enough to be able to handle the responsibility. There isn't a set age for this. I know adults who still aren't mature enough.
