I recived my I485 approval on May 30th after 10 years coming into this country.
I just want to mention my GC journey here, hopefully this will help atleast some of the members in making decisions in their process. Appiled for EB3 labor in jan 2004, even though i am qualified for EB2. Applied for I140 after the EB3 labor approval and received I140 approval. After realizing that the dates will never become current for EB3, my desi employer files for EB2 labor. Applied for I485 based on EB3 labor during the July Fiasco from the desi employer. After 180 days, took the permanent job with the client with base salary of almost 100% increase ( with bonus it might be around 150% ) and with manegerial duties. Mean while my EB2 labor from desi employer gets approved, so my desi employer files I140 for EB2 labor that gets approved with old priority date of Jan 2004 and I485 becomes current. Recevied RFE on my I485 for Employment Verification Letter. I took the EVL from both the current employer and the desi employer ( for future employment ) and written an affidavit saying that, i have the intent to join the desi employer once i recive my GC because he is such great employer, to keep the validity of I140 based on EB2 from desi employer. After one month of my RFE responce, i received my 485 Approval.
So You can always take promotions with more responsibilities using AC21, as long as you are in the same occupation, % of increase in salary doesn't matter. I have clearly mentioned my salary number in the EVL that shows huge difference.
My EVL clearly mentions that my current job duties includes more responsibilities and manegerial duties.
I read one big court case document involving 485 process by Rajesh khanna that the main important thing that USCIS looks for during 485 approval is inadmissability means no status issues. So as long as you are in the same occupation, you should be fine.
I had problems with my H1 and had to work around 150 days without H1B Approval after my I94 expiration, this was taken care of by 245K because of my travel to india with another H1.

221g means that additional processing is required - It can take about a month to get the visa stamp after you submit the docs. Did you submit the additional documents which were requested?

Thanks Paskal, I fully understand now with the example of the Scarlett Letter. I need to get busy and get another waiver then. Maybe I wasnt very clear on my first post about my stauts. I had had only a first J1 from 2002 to 2005. I wanted to stay so I got a waiver that time, and I tried to get a H1B, but I couldnt get it due to expired documents that I could not get renew from my country so my H1B was denied. Now some years later I decide to come back and the only fast way to come was with another visa J1. So as you explained I need to get my case number and start my process all over again. ONce I get the waiver I will look for a new sponsor and star the H1B process all over again. I cant be very open about this because if my present sponsor realizes that I am doing waiver and everything else I may loose my J1 because I signed a contrat to work for them for 3 years and then go back home. I think it is very unfair, but that is how things work around here.

All we can do is request and lobby.If senate feels right,they can pass a legislation.We can ask and lobby for it at least.
As it turns out,even EAD is not helpful as it has several issues which dont give you the total independence to do what you intend to.

Don't do the mistake of renewing it in India. I did that mistake and had to go through one hell of corrupt bureaucracy.
I am going to India for couple months and plans to return back on AP.I am planning to get my passport Renewal in India.Is it OK to Renew in India as it shows my India address.

I really appriciate the work of the core members.
i actively particiapted in the tech workers yahoo group, irrespective of hard work by many it failed to make a huge impact, probably because of lack of clear leadership & focus but in the case of IV, the core team's active role and leadership makes our voice being heard in the media and in the US congress.

IMHO, this is a legitimate website as I have been getting updates from them regularly and they are a supporting group for illegal immigrants path to legalization. As per the email I received today, anti-immigrants have sent 693,437 faxes to Washington this month to oppose reform.

If you find any company breaking the law, abusing the system or 'exploiting' immigrants as anti-immigrants allege, you must take action.
DOL USCIS must be informed. Search the forum and you will find resources how to do it. Unless we all take steps, there will be few bad apples that will give a bad name to the entire system.
I think it was Mahatma Gandhi who said that a person who accepts a bad deed and does not take action is also equally responsible as the person doing it.
IV strongly condemns anyone breaking the law. People must report it to the authorities. IV community must work on protecting the rights of the immigrants and support anyone who is willing to go against companies that break the law or 'exploit' immigrants.

this organization is strong and growing everyday because of the efforts of volunteers like you. thank you from all of us for your enthusiasm and motivation. iv does not seek to represent any one nationality, group or skillset. Once you start dividing there is no end. india vs row? EB2 vs EB3? STEM vs other? US degree vs Foreign Degree? BEC vs new filers? we have seen all these food fights take place. will it ever stop?
the goal is to end retrogression for all. if this happens incremental steps then the movement will continue until the whole goal is achieved. we, as a community of skilled immigrants cannot afford to be fractured. if we are not speaking with one voice, we will be ignored and those that oppose us will easily block our measures from going forward. among other things we learnt from this rally is that there are still those that seek to pursue narrow and divisive agendas within our movement. this will lead to sure failure, and each one of us will suffer for it.
as i have reminded folks here on numerous occasions, iv is not a brick and mortar structure. we are iv, and there is no iv but us. we determine it's strength and weakness and we shall determine its (and therefore our) success and failure.
some here fear what will happen when the current leadership get green cards. will iv go the way of skilled immigrant organizations of the past?
the answer to that too lies within us. a turnover of leadership is but natural over time. if new people are unwilling to step up and be active volunteers, start state chapters, create new initiatives and bring renewed vigor to this movement it shall die out. if new volunteers will not come forward in a fresh stream then maybe we don't deserve this. we are the arbitrators of our destiny.
i believe though we are more worthy than that.
the rally has also shown us (especially me- given that i took upon myself the task of working with state chapters) that there are very dedicated and highly motivated members in this organization that will work selflessly and give up much to ensure success. my grateful thanks to the many who made my life so much easier these past few months.

Are we so idle that we are thinking about changing the name of IV? Don't we have something better to do like taking part in IV activities?
Well how about chaging our own names too so that americans can easily remember our names? I think that its a good idea too.
The suggestion for the name change was to identify us as "legal" tax paying individuals, and not for the ease of remembering the name.
However, I do agree that it may be too much of an effort, and would recomend that when communicating with lawmakes and other inviduals, we introduce ourselves as legal tax paying individuals that are trying to reunite families and children, and provide ourselves the freedom and the ability to further our careers by attempting to streamline the immigration process.

As another member already indicated , I already mentioned my PD, country and EB category in my post.
Anyway, I had already waited 7 years in the GC process before recently coming across this forum and choosing this handle name when joining. Guess you could say that I was prepared to dig in and stay for the long haul if required which is why I chose that handle name. A few ups and downs/ forwards & backwards (even if in years !) in the priority dates won't deter me much now :).
Although, I could just be drunk with euphoria of my PD becoming current in March and blabbering away pompously. So don't you steal that login (pessimystic) away from me ! I reserve the right to choose it if and when I feel so :)

As all the I-140's from CA and VT were transferred to NSC in April so it is slow. I guess they are currently working on cases filed in the month of April. If your I-140 is not approved by December then you might want to consider converting it into Premium Processing so that you can avail the benefits of AC21 once your I-485 is pending for more than 180 days.

By now, we all know of at least one person who lost his/her job recently. Unfortunately, this is a very tough time for all the people around the world, not just here in the US. But, we have to worry about our status here in the US.
This is the one community which helps people like us, who are still waiting to go GREEN!!!. No body is going to help you or me get a job when we lose one. We have to help ourselves. We have to help each other.
So, Friends, apart from sharing the bad news of layoffs with the community, please also share any job openings here. Let us try to help the ones here, without a job, to get one. I know it is not a job portal, but this is the one place, where we all immigrants come together. This is the time to help each other. So, Admins, can we create a separate thread to post known job openings that can help our friends here at IV.

Q1) i am applying for the first time for my i-485 that requires i-693 form.
My question is, do i have to submit my i-485 together with my i-693, or do i have to apply first the i-485 form and then wait until i get a respond from the USCIS.

I was told that i am supposed to wait for the respond from the USCIS after applying my
i-485, and the USCIS will designate the doctors for my I-693, which means i cannot choose any doctors on my own. But in this reform , according to the users' discussion, so far i understand that you can apply for the i-693 form regardless if you have already applied for the i-485 form.
Q2) To simplify my second question, while i am applying for my i-485, and before its submission to the USCIS, can i start making an appointment with my local Surgeon?
You can. And the civil surgeon should be USCIS designated. Use the civil surgeon locator to find one near you:

I think what is being conveyed is NOT that he is superior .... but that he has been in the US atleast 2 yrs more than when he actually started the journey towards GC by formally putting in an application
