One possible reason is that Americans just don't want people smarter than them to come here and have the high paying jobs, create companies and have success on their own country.
It's OK to have a bunch of illegal immigrants to do the dirty work.
Let's think as a modern slavery. They want to be in command, to be the boss. It's their nature. And they just don't accept skilled immigrants coming here and taking the top positions from them. They want people who just take orders - from Americans.
I dont agree with that coment. Whether it is an american/foreigner, if you are not suitably qualified (work skill and knowledge + Social / managerial / personal) you are destined to be in the recieving mode all your life. Now I do agree that being in a foreign country, always it would be easier for the natives to reach the managerial position faster, compared to a foreigner. So what we can do is improve our skills and be more confident about ourselves. The american citizens have been exposed to years of economic prosperity that has lead to the belief that even if they dont study / work hard the country will provide them the jobs to enjoy life. When suddenly they find that they are not enjoying the same liberty (chaning jobs as they wish, bargaining for more pay, employer at employees mercy kind of thing) they are unhappy and are starting to complain. Now regarding ilegal immig doing dirty work, its not the fault of the american employer. Its because the workers find, what you call as dirty job, better than what they have at home.

Same thing happened to mine. USCIS will pick up the packages from the USPS the next day so don't panic. Check for another status update tonight or Monday night, I'm 100% sure it'll say "delivered" then.

The spokesman thinks that immigration bill passing this year is a longshot but a lot has been built for it to pass in 2007.

The FBI name check is not a side problem that once we finish fighting other problems, let's come back and pick up another problem. This is one of the major obstacles in the GC and Citizenship process which unfortunately is not transparent and there is no data available to tell you when you will pass this obstacle. If the attitude of some of the members in this organization is the delay in FBI name check is not going to happen to them and it is only random and a side problem, think again and watch out for what will be coming your way. By no means, this is not a side problem, this is one of those hidden obstacles that you don't know it is in your way once you hit it...and once you hit it, you are stuck. There is no congressman, senator or individual to help you. If we are going to be united and make the GC process transparent, we should not hand pick some of the problems that we want to fight today and come back to other problems later. You are going to soon realize how gigantic the delay with FBI name check is.

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.
If you have prior experience please let me what to expect and do any preparation now itself.

But at least they are getting GC in 6 months. I dont mind getting paid low if it means getting GC in 6 months. Anyways half our money goes in getting h1 extensions and paying lawyers so might as well get it over with by getting paid low. It is so disheartening to know how people are abusing the law and getting GC the short cut way while our stuggle starts with getting admission to f1 to doing our masters to trying to get h1 and then GC.
I have a friend who has done his MS from a top school here and his wife is a dentist but cant work for last 5 years and here is a guy whose education is a BCom and his wife's too and both are working and have got the whole thing the easy way out. Very disheartening.

Hello everyone. I was following the "IV in the News" Thread and I saw something that may be the reason why the layman thinks IV is an "Indian Organization".
DISCLAIMER:
1) Now b4 everyone jumps down my throat, i want to mention that i KNOW how hard IV core and supporting members have worked to get these articles into the media and I MORE MORE than appreciate that fact.
2) I am not trying to play "seperatist" here (as in Indians v/s Non Indians).
Now for the facts. I was going through the articles one by one and I compiled a list of articles matched up with a list of names. I have posted first names only.

I know that these articles come up on the spot and the media team sometimes has only a few hours to report a candidate to the reporter. All I am saying is that if more such articles are done in future, can we have the Non-Indian members also step up and contact the IV core/media team coz this would truly lend a "multi-cultural" look to IV. The lay-person american does not know what IV is comprised of. With them What u see is what u get. They see Indians in the media and on the news speaking out about the Immigration wait times and they think IV is an Indian organization.
This is a request to both the core team and the non-indian active IV members to please step up and co-ordinate future (such) events so that multi-cultural faces can be seen in the media as well as when we go to meet the Congressmen.
Once again, no disrespect meant to either the core/media team or to the non-indians on this forum. I hope people can see my point. (I am an Indian citizen myself). If efforts in this direction are already being taken, i apologise in advance.

There should be a separate quota for Master's degree holders with existing jobs in their field of study. That would weed out people joining random schools for a Master's degree just to be part of that quota.

I140 denied from NSC .got REF on 03/08 . Was for A2p.fellows got same RFE and got approved from same employer but mine got denied .Didnt get official notice yet .What are my options .please advise.
Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .

You can apply for extension. Fees are not applicable for extension of status. If it involves status transfer e.g H4 to H1, then you need to pay the fees. I extended my wife, and daughters status just by filing the paper work and got the new I-94.

How is this possible, EB3 ROW also has a limit to how many they can use correct? They only can use what ever is beyond the 7 % used for India/China/Mexico/Phil (28% in total). Out of 1/3 of the 140K.

I think EB3 - ROW will stop or retro. next month or for sure in the next couple of months back to where they were. Lot of people here are saying that ROW will be current soon I am not sure where they are getting these facts.

ROW is the rest of the world, and yes they get to use ALL of the rest: within ROW spillover occurs from EB-1 to EB-2 to EB-3, so whatever visas are available/leftover will be used up by EB-3 ROW -- they have suffered massive retrogression for many years, and now early PDs will not be stuck in the FBI blackhole.
I am not saying that EB-3 ROW cutoff will necessarily move further forward (i.e forward from Jan05) -- DOS intent is to use up all the remaining greencards -- and it might well be that the current cutoff will achieve that goal -- if it doesn't only then will they move the EB-3 ROW dates forward.
