Hello,
My application also returned for the same reason (no I485 receipt notice attached) from Phoenix. Not sure what to do at this time. I never received I485 receipt notices. Hence, I have attached biometric notices in place I485 receipt notices. I have added a cover letter requesting to expedite the process. I am not sure if this request caused some mental disturbance on the person who is supposed to work on my application and may have sent me rejected notice.

My 6th year H1B is expiring on April 28, 2008. I applied labor through PERM on October 2, 2007. I got the audit letter on December 3, 07. This audit letter does not state anything about the issue of the audit letter. However, the sentence The job duties and/ or requirements are beyond those defined for the job by SOC/ O*Net code an Occupation Title provided by the State Workforce Agency is highlighted in this letter. The letter also request for Business Necessity Letter and Recruitment Report. My case is the EB2 case for a Project Manager position with a minimum of 2 years working experience. A couple of programs and knowledge in the field are also required for this position. At the recruitment times, there are no applicants applied to this position. The company has approximately 16 employees including me.
Im very confused and not sure what to do because my lawyer refused to answer any question. In my case that the Labor Certification is still pending (under audit) and my H1B is expiring in April, I wonder if I should start taking vacation now or go to work in another country for approximately 6-7 months and come back later to use the rest of my H1B until October 2, 08 to meet 365 days period? After October 2, 08, I can then start filing the H1B Extension for 1 year. Or should I wait until my I-140 approved and come back around October 2, 08 and do the H1B Extension for another 3 years? Or should I stay in US until April, 08 and take vacation until October, 08 and then comeback around October, 08 to file H1B extension? Also, do I still have to be employ full time with my current employer during this whole period? Can the job only be part time? Also, do I have to get pay the whole time from my current US employer during this whole period? Thank you very much for your help.
Highlighted area is the problem. Is your lawyer recently graduated? EB2 category is meant for minimum 5 years experience and whne your title is having the word "manager" it becomes more stricter definition.... In my opinion EB2 is always about minimum 5 years experience and that is where your lawyer screwed you. And yes the reason highlighted in the audit letter is real reason and it is direct indication of this conflict.

After all these days it appears many people are still not clear about the difference between 485 processing times and priority date movement.
The two are completely different entities. When USCIS talks of backlogs they do not mean backlogs due to retrogression (PD unavailability). They are talking about the number of applications they received and the time it takes for them to process them.
When USCIS says it will clear the backlog by 2010, it means applications filed after that time will be processed in a timely manner (in less than 6 months). It does not mean that all the 485s before that time wil be approved. It only means these 485s will be processed and thrown into a cold sorage bin to be looked at again whenever the PD becomes available.
When retrogression started in 2005, EB2 India jumped forward by 6 months each visa bulletin. The reason was namecheck delays combined with the problem of Labors with Old PDd languishing in BECs. As both these problems have been eliminated now and also many EB3 filers from that time are switching over to EB2, it is highly unlikely that one will see wide movement in India EB2.

Maybe USCIS is already processing the PD 2007 for India, and the VB Bulletin next month will be current for the others. If thats the case they already advanced the cutoff dates.

Hi Guys,
I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.
He ask me that what could be the best way to avoid this fees , some of the option that we thought about,
1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?
2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer
3)If US client utilize remit2india, ICICI to transfer money which I highly doubt
I appriciate your responce on this.
#1 - he would not be able open the account here without SSN/EIN and need to pay the tax here if register his company here. Corporate tax rate is 35-39%
he is better off with 4%

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
People here have related change of address to RFE but I personally do not blv. it happens as I changed address 3 times and nuthing adverse happened.
Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.
Good Luck.

My point was that it doesn't matter. It represents $1000/ per person, hardly enough to make a dent in poverty. We need sensible labor laws, a pro-business attitude, and that money will return to India.
Dude this huge money can change India's future .Consider that National River linking project, all high-way and Railway projects
http://nrlp.iwmi.org/main/maps.asp
Imagine if this happens in real time we wont be fighting for GC here these westerns at our door step.

More H1-B workers in the labor pool and in GC Line ...so more outsourcing openings for Indian Companies ...:)
Adding more H1B is what every employer aspires. They don't want you to get GC soon enough so that you leave them for better prospects.
No one is going to raise the GC backlog issue. Is there a way by which the we can also ensure that companies also stress on reducing the backlogs in EB categories and re-capturing past immigrants visa as a interim relief as they lobbied for increasing H1-B caps

You are exactly right. Both H1 and L1 are dual intent visa so why would one be considered resident while the other one non-resident? I don't see how L1 can fulfil the requirement while H1s can't.
I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?

Thanks for your kind reply. Yes this amount of 40K is what i saved from my salary after my employer deducts taxes via withholding. I am confused because I read that you have to declare any foriegn accounts help while filling for taxes here in US. I made these trasnfers to my dad's account and I dont have any NRI account. I am not sure if I will fall into this category and have to declare all this. Thanks again for your help.
You dont fall in to that category and as several members mentioned you dont have to pay taxes for remittances as you already paid tax while earning it.

I dont think you need to be worried. my friend( Came to US in 2003 after working in offshore with the same company for 2 years, but his company filed his GC only in 2006) got this interview in March 2008, they reviewed all his papers(W2's, Birth Certificate, all Employment letters) and said that its ready to go when PD becomes current. His PD is 2006 March ( Perm),EB3, I 140 Approved , and now he is waiting for his dates to become current to get the GC. His case is pre-adjudicated and is ready to be released as per USCIS. His attorney didnt go for the Interview.
One of friend attend the interview in Feb. 2008 his PD is Dec2006 EB2,they asked him his birth certificates,W2,recent pay slips proof for his current employment, after the interview they told him that your case has been approved but you need to wait until your PD gets current.
