I read a post (sorry dont have the link) that they had juxtaposed first and last names while filling the app - called uscis and got it corrected.

Yes, I am definitely for this idea that we should petition/ask USCIS to change the rules to allow those with approved I-140 to be able to file I-485 while their PD is not yet current even if we would pay US$5,000.:rolleyes:

Doesn't the recent USCIS Yates memo (the same one that said that H4 time will not be counted against 6 year H1 limit), also say that dependen children will be granted a GC if they were under 21 at the time of filing the petition? They need not necessarily be under 21 at the time the petition is approved...

No, there is old Child Protection Act and it protects from aging out while I-140 is in process. So child age is determined as age on time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS.

You mean to say CIR will be introduced to the immigration or judiciary senate committee or introduce directly to the senate. If it is introduced directly to the senate floor that will save a lot of time, on the flip side it will become difficult to add or change provisions if it is directly introduced to the senate bypassing the senate judiciary and immigration committee
Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.
Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. The whole point of having a committee is to be able to either kill the entire bill, or a congressional appointment before such a bill / confirmation is debated by all 100 senators. Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.

Did anybody fly recently in Lufthansa to India? I wanted to know whether you need transit visa.

My travel agent says you dont need transit visa if you have AP.

You forgot the lawyers. How does it affect them? They are an important part of any law when written or changed.
Though there is no charge to revoke I-140 from CIS, corporate lawyers do charge money and that makes it in their interest to convince & pursue HR ppl to do so.:(

If one changes from EB3 to EB2, then priority date is lost!

(I am not expert) but I believe , you have to refile (New application) under EB2 catagory and port the EB3 date to EB2.

Hello I'm from Greece.
I noticed the mentioned problem these days and I'm fully frustrated!
You can't imagine my dissapointment when I saw the pictures of a wedding in 20x30cm prints having flares and out-of-focus areas spread around.
The problem is this:
No matter the lens, no matter the focal length, the d70 produces an uneven focus area. A focused area in the middle of image, is out of focus in the edges. The focused objects near the edges are far behind. The problem is more obvious in the right edge, especially the lower half.
I made some simple tests and unhappily this was true.
I own this camera for the past 3months.
I wonder what the nikon people could do about that.
I 'm not happy to lose the camera for the next 3months... in order to send it to the service

I am having a good attorney .He is desi , He is reputed , have good experience , he has got good web site also. He is waiting to see what is there in the denial notice.The denial update on website is 18th.so it may take another 3 weeks for him to receive the notice.
In the mean while I am trying to get an employer to file a Labor as future Employee.since only 6 months left on H1b , I dont know what options are left for me.:confused:
since the I-140 is not clered, my priority date canot be captured.

USCIS officially released the information that total I-485 applications which were related to July VB fiasco before August 16, 2007 were 320,000. During the period, the USCIS received 400,000 anxillary applications (EAD and AP), and substantial number of concurrent I-140 petitions. All of these figures added upto 800,000. For the USCIS verification of this information, please Q&A between the USCIS and AILA as part of the Community Relations meeting on September 25, 2007. This has been made available today.

There's a EB3 140 approval drought in not just NSC, but TSC too. I think it's going to get worse with EB3 becoming U. I am myself EB3 Mar 2005 and my job isn't looking very stable after my company resorted to outsourcing.
Can we suggest to AILA reinstatement of premium processing for those who've waited beyond some acceptable period of time? The same way they are doing for people whose H1's are at the brink of expiration.
I don't see any other way they will ever give heed to this problem i.e. where no monetary gains are involved.

Yeah, it's just been a day since I got this news so I am still processing it, talking to friends and colleagues.
I am going to look around for people who are going to file.
Thanks for the advice about taking a lead on things, and also pushing my manager to file it.
And it is true that they are planning more layoffs over the next few months, so I am in the soup if things stay this way. All good ideas, which I am willing to experiment with.
I am also looking at this as a golden opportunity to do something that I wouldn't have done if my GC process was going on - like move somewhere else to a smaller firm or change my job title a bit.
Or travel to Canada or Australia and work/live there for a bit, explore the world, and come back later.

I-102 will not work you need to file I-539 for extension of I-94.
I-102 is for replacement I-94.
I am sorry but the rules clearly state that passport needs to be 6 months beyond the intendent travel period.
Unfortunately for H1 that could mean several months or 2-3 years.
