I have a question for you. I had lost my birth certificated and fortunately my father was visiting us so I get an affidavit signed by him. My mother is no more and my siblings are in India. Would there be a problem as I sent an affidavit in lieu of birth cert with just my father's signature? Please let me know.

At what point of GC process you don't need your lawyer anymore? Is it true that after filing I-485, and if everything is smooth with ur case, you don't need lawyer.It's hard to answer. I still have a lawyer and all correspondence is going to lawyer. You never know how tough RFE/NOF could be. But I file EAD and AP myself without lawyer.

Also to be really frank I don't see any help from Indian politians, but let's give it a try.
They will not care for us at all! But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!
;) Hey, if we were so lucky - one of us might have won $365 mil Powerball, and donated $200K or more to IV outright! I would have, I know that for sure!
But, we have to keep trying every which way! Everything to gain- nothing ventured, nothing gained! Please, do not misunderstand me - I am not making light of somebody's ideas! Great things happen only if we keep trying!!!

The FBI name check is not a side problem that once we finish fighting other problems, let's come back and pick up another problem. This is one of the major obstacles in the GC and Citizenship process which unfortunately is not transparent and there is no data available to tell you when you will pass this obstacle. If the attitude of some of the members in this organization is the delay in FBI name check is not going to happen to them and it is only random and a side problem, think again and watch out for what will be coming your way. By no means, this is not a side problem, this is one of those hidden obstacles that you don't know it is in your way once you hit it...and once you hit it, you are stuck. There is no congressman, senator or individual to help you. If we are going to be united and make the GC process transparent, we should not hand pick some of the problems that we want to fight today and come back to other problems later. You are going to soon realize how gigantic the delay with FBI name check is.

just like in TX, the dl issuance is not related i-94 date. i lived in all these states.

Well currently I live in MN and I have lived in NY before. Both states issued me DL valid beyond my I94 expiry. However in both cases they include "Status check <date>" in my DL, where <date> is the date on which my I-94 expires. So in either state once you go beyond your I-94 expiry date they can cancel your DL.

What I had (mis-) understood till date was: there were 2 ways for employment based GC: 1) if I was outside US all along, and the employer applied my employment based GC for future employment, and 2) if I was working in US for the employer and he applied for my EB2 GC based on the job that I was offered and was working on.
Both are for future employment.
1) means immigrant visa at consulate abroad (consular processing)
2) choice of immigrant visa at consulate abroad OR I-485 application to adjust status
It is possible to switch from I-485 to immigrant visa abroad by filing I-824 with NVC.

Here is my current situation
1. Entered US on H4. H4 is stamped on the passport until 2010.
2. Applied for EAD (July filer) and current using EAD for work
3. Will go to India this year end and planning to come back on the stamped H4.
Here are my questions
1. When I entered on H4, on the POE, the officer would have marked my status as H4. Now, I have used EAD...so currently I am on AOS pending status. How do they know this? Is this based on the I-9 that I have filled for the employer? But I9 form is retained by the employer unless requested by USCIS, so how does USCIS know that I am on EAD (AOS)?
2. When I go to India, I will surrender the I-94 that I received when I entered on H4. So when they tally their records, will they treat me like H4 leaving US or EAD (AOS) leaving US?
3. When I reenter US on H4, again my status will change to H4 right?
4. At this time I assume that the EAD card that I have is still valid (Not invalidated because I entered on H4 and not on EAD/AP. So, If I have to start working again, Do I need to fill the I9 form again for the same employer.
5. If I do not fill the I9 form, then how will USCIS know that I am working on EAD...which means that my status is AOS pending?
6. In my case, the primary applicant chooses to remain on H1. So if our I485 gets denied does this mean that I am out of status because I am using EAD or does it mean that I am fine because I entered on H4 and that is what they have in their record.
7. If I am out of status, can I file for a change of status to H4 or an extension to the previous H4 from US itself so that I continue to be in status�or do I have to leave and enter the country again?

Babu, thanks for confirming that this stupid rule is in fact true. I always wonder how USCIS gets crafty in making new rules.
It will be easier to just get the stamping done in INDIA. That way, will get stamp till 2010.
Looking at reply from Babu. I think Babu. got I-94 corrected through Amended H1 (INS) . and then travelled to INDIA. While returning from INDIA
by the last updated rule He would have retuned with a valid I-94.

Friends - this thread was mainly for a pat on the back to PK since he did such a fine job singing it.! IV had no malicious interest in singing the US OR NOT singing the Indian anthem at the rally..!! Our effort thru the rally is to show how we have adapted to this country (USA). There is no point in posing a hypothetical Q like if the US attacks ur mother country (sorry dressking..ur way out of line.!)..that ain't happening.! I am an Indian first and i will take that to the grave..!! We all walked the rally and were present there so that we could try and address the political system of this country reg. our plight.! I don't see any reason for this thread to be turned into a political one...whether how he sang it...what should have been done before or after PK sang it, etc...THE LARGER PICTURE is that IV has respected the US national anthem and has not disrespected the INDIAN national anthem.!! The RALLY surely had a positve impact (read all the news articles...no one commented about the anthem.!).. Again this is the first time that the rally has been conducted on this scale and YES we are learning on what can or cannot be done for the next one.!!

I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.

My colleague filed 140&485 in August. Her case was sent to TSC. So far her 131, 765, and 140 approved. Also, she has done her FP. What a different! I was wondering what's the purpose of "bi-specilization"??
The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.
BTW, it is awfully quiet here nowadays.

I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!

My Ohio license will expire soon along with H1B. As far as my attorney says, when the original H1B application receipt presented, BMV issues one-year renewal. With the H1B approval, they renew the license for three years.

Since I140 petition is for future employment, it shouldn't matter that you were on F1 when it was filed. However, you may have a problem with adjustment of status. You may have to do consular processing if you are still on F1. But since you've changed to H1, I don't think it matters again. Could you consult an attorney or pose this question at the next attorney conference call?
