I need your help in this scenario. I went to India during Mar 06 and got a stamping on my passport till Jun 2010 (based on my I140 approval). But at the POE, the officer stamped my I-94 till Jun 07 as he could only stamp the date that was on my current I-797. He also told me that I can goto the local USCIS office and extend my I-94 till 2010. Is it true? and if so, how would I go about doing that??

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.
Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.
In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)
[Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]
In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)
In both the cases, US is a clear looser by not taking advantage of the skill sets they have.

Hello All,
I have a valid H1 (I-797, I-94) till 2009, but my H1 Visa on my passport has expired in 2005. My wife has a valid H4 till 2009; similarly her H4 visa on her passport got expired, we haven�t traveled outside of US from then. Now she is planning to go to India next month because of some family urgency and she is planning to take an appointment for H4 visa stamping in Chennai consulate (India). My question is, is there going to be any problem for her stamping as my Visa on my passport has been expired even though I have a valid H1 I-797 till 2009?. Is there any rule which states primary applicant has to have valid visa on his/her passport for H4 stamping.
If any one of you had a similar situation please share your experiece, it will be very helpful.

There is no such thing as a cooperative employer in this economy. I will give you an example, recently in my wife's company they had advertised for a genuine job and on the first day they recieved 200 applications!!!!!!!!!!!!!!!!!!!!!!!!. The hr after one week has not been able to review just the first day responses. because of situation like this no company is willing to even file for eb3 labor leave alone eb2. Because they cannot justify a perm labor when they are recieving dozens if not hundreds of resumes. It is because of situations like this that labor department is becoming stricter and stricter by the day. The post below seems to suggest even if you get audited you will get approved in 1.5 to 2 years. In this environment where unemployment is rampant there is very little chance of success in getting perm approval even in eb3 so dont be under any illusion that no matter what perm would be approved. It will not be approved under current market conditions because of hundres of resumes to perm advertisemsnts. it is because of this reason that a vast majority of companies have decided not to sponsor green cards. there is no such thing as a "coperative employer" in this economic conditions. Companies are being forced to send employees away from US because there 6 years of h1 are comming to an end and they are not able to file green card in this economic conditions.
OP - If you have a cooperative employer, I would say go for it. Given the rate at which EB2-I is progressing, you will get GC much sooner although the PERM process for EB2 may take a long time. Assuming you get an audit on your PERM, even if the entire process takes 1.5 years, you can get your 140 in PP and once your PD is ported, you are current. Even if the entire process takes 2 years (worst case), it's worth the effort. EB3-I will move at a very slow pace. As others suggested, you wont see significant movement till EB2-I is current.
Financially, the porting would make a lot of sense too. Assuming a family of 2, you are spending close to $1000 (or even more) per year on the AP and EAD renewals, not to mention the employer's cost of renewing the H1. When you go to your HR for starting the EB2 process, you want to put it in terms of how it's financially viable for the company. When you do the math, it's a win win for both the employer and the employee in the long run if you get the GC earlier.

My AP application entered in the system on Sep 13th at NSC - what is the likely approval time these days for AP.
I have vacation plans but i've very slim H-time left and that too not stamped (its a extension) so i have to have the AP at hand before leaving. I can't book tickets because i dont know if AP wil at all come before my Journey date.
Any advise or experience sharing would be a big help. Is there any way i can rush/expedite my AP application from NSC ?

However i totally forgot about my I-94.
So you think the only way to get the i-94 extended is to go out of country.

Let me be clear. my H1 is with a different employer than the future GC sponsor. I never worked for the GC sponsor and that is the reason wanting to get the H1 transferred to sponsoring company. As said I 140 approved and I 485 passed 180days.
I was under the impression that you can switch over to H1 from EAD easily.
if there is a gap of 40days will it be ok to file H1 transfer? assuming that I get the H1 approved. Will this gap any issue in 485 adjudication?

I was in Chennai for a visa stamping on Dec 20th. The process both outside and inside the consulate has improved a lot. This was my 5th visit to get a H1 stamp. This time the experience was a little bit different in that they sent me back saying the photos i had were unacceptable. It is not a big deal to get the passport photos outside the consulate but does create a tense situation which can be avoided. I took photos from here (picture people - told them it was for US visa) and it was unacceptable in Chennai. Please make sure that you have the photos as per the VFS specs mentioned on the website. Other than the photos the only thing i was asked was the most recent W2. No questions. Hope this info helps.

Did you file for I-485? If so, what is the address mentioned in the I-485 application? If it is US address, then you should be residing at that address.
I-485 application indicates that beneficiary is residing in the USA and applying for adjustment of status.

The address on 485 is a US address. I was in Jersey City when my firm applied for 485. However, subsequent to 180 days of filing, I transferred to Detroit practive with the same firm. And, I provided my cousin's address in Detroit where I lived temporarily. Subsequent to that, I moved to Windsor, Canada, because it is a nicer place to live.
I did consult with my attorney at that time, and she suggested that it is fine for me to live in Canada.
Your suggestions?

Please kindly remind your friend to withdraw the EB3 485, and file marriage based 485 instead. There is absolutely no need for him to waste a precious EB quota. And, it is believed that marriage based 485 passes NC much faster.
I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.
Here are the details
Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.
Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.
October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.
Jan 2007 : I 140 approved.
Nov 2007: Took Infopass appointment. Was told case pending name check.
This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.
