My passport expires in Nov, '07 and am planning to travel to India shortly. I would like to know if we are required to submit the original/copy of I-94 for passport renewal.

Yes. Even I did not know it. I was trying to find out if Cspan was showing the hearings in Dallas and found this. I immediately tried calling the lines but they all seemed busy. There were some callers who were criticizing foreign high skilled immigrants and that jobs were being taken away from them and wages were being lowered and they are being allowed to come and stay in the country.
Lets see how the hearings go in Dallas. FYI IV has tried contacting the speakers in the hearing.

I'm sorry if this question sounds trivial, what is LUD? My FP was done on Sep 19 and I checked the uscis website today using my i-485 receipt #. I don't see any update. Please let me know.
You have to create an online account to get updates on you application. You will see LUD and there is the date everybody is looking for. You can also receive email if take the option.
You will not see LUD if you just put in your recipt number to check status of the case.

ask lawyer to file MTR and resend response to RFE along with it. You should get a quick response (within 4-6 weeks). If MTR is denied, ask to file appeal, but sometimes it's better to change employer and start from scratch. Appeal can be a long process.

I know this isn't a solution to your problem, but some people may consider sending their kids to Canada to study. Canada's universities are en par with the best US schools and the international student tuition is often less than in-state tuition, although the declining US dollar has made it less the case these days.

Good it all worked out for you. I am sure they stamped your passport on the way back into USA. Just keep track of your intrnational travel at some point it might be required, you might loose track of them if you don't have exit or entry stamps on your passport.

I did not have a exit date on the passport. At the border they just took my Old I-94 and let me go. But when i came in I got the admit stampted. I hope its not a issue right?

Well H1B can bring their spouse using H4 .. so I guess GC holder can not bring their spouse .. I guess this is a hole in the system.
H1-H1 couple can support status of each other (H1-H4 or H4-H1)
H1-F1 couple can support each other (H1-H4 or F1-F2)
But
GC guy can't support status if H1 spouse lost job and became out of status
GC guy can't support status if F1 spouse becames out of status
GC guy can't bring spouse from home country
UNLESS SPOUSE/Kids goes through complete F2A visa process (several years)
It can make life of GC spouse miserable (of course GC guy also). Imagine GC-H1 marriage, H1 out of status after loss of job. After loss of status, H1 spouse has to return, but GC spouse will try to remain in USA for own status and in hope to bring spouse back after getting citizenship.

Labor substitution case..eh..
All,
My employer revoked the i140 of a person after 180 days. He did not reveal this information to me and used labor substitution for me.
The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals.

porting can be beneficial but attempt it only if you are 100% sure that it will succeed and talk to your lawyer before you do it and don't attempt to do it yourself. it will be a lengthy process with increased scrutiny. 3-4 months for labor and atleast 1 year for 140 processing and moreover DOL is making it tougher for EB2 with strict adherence to the rules and increased scrutiny. after all this, there is a very high likelihood of getting RFE from USCIS at 485 stage. if any EB3 person has EAD, AP then it would be best to play it safe and stay with EB3 as you already have the benefits of EAD and AP. I know it would be much much better if you have a green card, but would you have it safe and sure or do you want to go through all the stress of refiling and preparing for all the problems in the process? it should be ones own personal choice. moreover I am hopeful that things will move favorably after the elections with the immigration reform and might result in some relief for all EB categories

I guess its much better for frauds to have an EAD/AP, then they can easily bypass the checking at consulates.

Yes, the rule is to carry the original. If lost, apply for a new one. So, i preached.
