I'm pretty upset too after getting the same nasty surprise. Fortunately I only have about 100 miles to move to return home. I'm surprised that a major corporation like the one that hired me would be so sleazy.
They say that they will start green card process.
They cant and they dont promise how long it will take.
So its your job to do the homework. Even now i come across
people accepting job offers with lesser pay because they promised
green card processing (and have no clue about the backlog). I tried to explain him and he didnt seem to take it seriously. I guess he will (and thats

I listen to him frequently. I'd strongly recommend not contacting him. Even if he is pro legal immigration, he is very moody and could say something bad that we don't want to hear. He likes Indians but hates Chinese. He also hates Tabla by the way!

My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...
Receipt date and not notice date is the factor.
Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

My case status online does not say anything about when it was received. It just says, "This case is now pending at the office to which it was transferred.". There is so much ambiguity at USCIS that it takes tons of reading / pulling hair just to understand what they mean. They have transferred my case three times. First of all there should be a reason for it (no reason makes it you wonder why ??) , then if they keep transferring it from one center to another, does that mean that the "received date" will be changing for ever and the case will never be processed ? I think USCIS should be accountable for that.

Procedures described in link mentioned above, has a protocol on determining proper processing center, which has a complex formula based on state of residence, center approving I-140 etc. If your I-140 was approved by one center, and if in the meantime you moved to a state in different center jurisdiction, or USCIS changed jurisdictions, it might have created ambiguity on who should deal your case. Back and forth transfer suggests that centers are not agreeing on who should deal with your case. You may want to try an Infopass, which would let you know if your case is preadjudicated. If so, you just need to wait for PD to be current again.

I recently moved to Cincinnati, OH.
My I-485 was filled in TSC; when I did an e-file today for I-131, the receipt confirmation documents to send it to TSC.
All other documents on the uscis site suggest sending it to NSC based on OH State.
Any suggestions will be appreciated.

What a crack-head - I didn't know H1Bs were 5-year visas - I guess I've overstayed my welcome...
And to say that everyone stays here is ludicrous - Half the people that started with me on my project have gone back to India for better positions with better pay and the rest have gone on to green cards and some even citizenship. He thinks that everyone stays here after 5 years (???) and then works illegally - like that's possible - idiot!
He thinks a company hiring skilled workers like computer analysts is going to let you stay on past 6 years if you haven’t filed for your green card and jeopardize their reputation and legal standings? They would just hire new H1B workers and kick you to the curb – at which point you would have to work under the table flipping burgers – but I guess the ignorant freak thinks that’s better than going back home and getting a project managerial position, because all other Countries are third world and live in mud huts?

Are you sure? Cause I did work with them, no one imagined the crisis of real estate was going to be soooo steep and also no one imagined that my i-485 was going to be approved so fast.
I can proof I worked with them from 2002-2006 (4 years). They gave me a letter saying they still not able to get me a job, i did have intent to work with them.

At what point of GC process you don't need your lawyer anymore? Is it true that after filing I-485, and if everything is smooth with ur case, you don't need lawyer.
One more question, at 485 stage , if there is RFE/NOF, does USCIS inform you or your Lawyer?

My case is very straight-forward but some really inefficient guy is making it complicated. I need your experience and inputs. Please do advise.
I came to US on J-1 in 2000. After 3-years on J-1 got 'waiver (i-612)" and then moved on to H1B visa and filed I-485 in july07 (with an approved I-140). I have stayed with the same university medical school (my GC sponsor) since 2000. Last month, I got a simple RFE --asking for a copy of approval notice of 'waiver' . Same was sent within a day and it followed with several LUDs and read rfe response received.....
Last week, got 'Notice of Intent to Deny (NOID)' for myself and same/ditto for my derivative-spouse. It is asking both of us to provide evidence/ IAP-66 and H1B approvals to prove our legal status from 2000 to 2006 (Please, note they asked only until 2006 and not until today). I have IAP-66 and H1B approvals ready to respond to this.
My Question is: Since my spouse/derivative was my dependant and was on J-2 visa, the IAP-66 were all in my name how should we respond to derivative's noid as-far-as IAP-66 approvals are concerned. We know IAPs and waiver are good for dependants and I want to end this back-and-forth with my response to uscis.
Please, advise and let me know of your thoughts....

Your BE degree will be considered equivalent to guys who have 12 + 4 from India. After all you have a fulltime 16 years education with same degree that 12+ 4 guys have. I think AMIE is getting the flak because its considered part time degree ( I know how difficult it is to manage job & AMIE studies) but that is how USCIS is interpreting it at the moment.
I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).
Is it considered 4 year degree and good for EB2 along with prior 5 years of experience?

Press coverage in India is an excellent idea. I think this bloody american press is biased. We should all write to Indian press and highlight our issues in strong words. If we can get 100+ letters to TimesofIndia, HT, IE , NDTV, Deccan, Hindu, etc, we can highlight the discrimination and indentured servitude to the young Indian generation who has high hopes for USA. If 100+ H2B workers can stage dharna in front of an embassy/white house why cant issues of Indian people get highlighted? Lets us show the job here in the same light as slavery in middle east. I am sure David Mulford will be ringing a few phones after that.

My LCA has Computer Software Engineer as job title.I have 5 years of Experience as Oracle functional consultant.Currently I'm working as Oracle consultant.My 140 is approved and got my EAD card.In jan 2008 it will be 180 days of filing 485.I want to change my career towards IT Sales.
I have an offer from an American Staffing company as a Technical Recruiter.The job responsibilities include hiring Software Engineers.But the job title is different from my LCA.I want to join this company using EAD in jan 2008 and apply AC 21.Today I have checked with my Lawyer this is what she says"
In instances such as this, when we send the letter to the USCIS regarding AC21, we include the following details with reference to the job title. � Although the job title differs, the job duties are substantially the same. The title used by the company is their internal designation for this position."
She says that i will be able to work as Technical Recruiter using EAD.Any one can suggest me on this?I have very little knowledge about AC 21 and how it works
