If you want to elicit a response on retrogression, then you have to call their office and ask to speak with the person that deals with immigration issues and policy.
Or you can seek an appointment with that person and see what they have to say about this. Writing a letter will get you a generic form-letter response from a junior staffer whose job is to pick one of the 25 form-letter responses based on issue (Iraq, healthcare, immigration, veteran's affairs, crime, gun-control, abortion, judicial appointments, taxes, etc. etc. etc.) and slap your name/address and stick a postage stamp and mail it.
So, if you want to talk about immigration with them, call their office. Talk on phone or seek and appointment and meet them to elicit their position and educate them on retrogression.

Friends,
Are we required to carry GC with us all the time ?
My attorney says we must. What if I lose it or damage it ? Can we carry a photocopy ?
Yes, the rule is to carry the original. If lost, apply for a new one. So, i preached.
I never carry it, one day one immigration officer is going to catch me and grill me.

yes, my I-140 is approved. If your old employer revokes the I-140, as part of the processing of that revocation the USCIS *might* issue an RFE or NOID asking you for an updated employment verification letter. Per my attorney its more likely that USCIS wont do anything to the 485 right now, but will check the status of the I-140 while processing my 485. As part of preadjudication it might happen earlier, but also possible that it will only happen when my PD is current or almost current (July-2006/EB2/India). At that point we should get an RFE, and thats when my attorney plans to inform USCIS about the AC-21 change of employer.
Just a quick question:
My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.
I appreciate any response.

This is not a flaming forum. There is no need to take an advise given to a person personally and then call other people names and take a high pedestal. If you are in a position to take an advise take it or leave it.
Now to your observations and my responses.
1. I am a full time employee too with a fortune 500 company working for the past 6 years with the same company since I got laid off first after working for another American company for 3 years. So there goes your argument for working with a desi company.
2. Never been on bench due to the above reason
3. you probably were in your high school or early college when I started my programming career back in 93 and now work as an Enterprise architect. So just chill out and don't try to categorize people based on your limited understanding. Don't even attempt to talk about my skills and what I know and don't.
4. You just equated one simple post of helping a fellow person by advising him to be here for some more time to get a job to 'faking my entire career and labeled me as a fake'. Shows how mature you are
5. Its good that not a single line in your resume if fake.. then you should not be offended at all by my statement.
6. Oh BTW.. I do happen to have 2 Master Degrees from US of A and more than amply qualified to apply in EB2 category but due to the HR policies of the company could only apply in EB3.
Now cool down and take your frustration elsewhere..your time will come..
cheers

What makes you think that everybody fakes theirs resumes? You are talking like its just a matter of fact that faking resume is the only way people get jobs (and what is this project business????). I now know that YOU got your job by faking your skills. And shame on you for doing that!
You conveniently missed out the 4th reason in your list
The employers filed for H-1Bs kowing very well they did not have a job to give to the candidate. The immigrants would come to the US, get "trained" to lie their way into a job, pratice more lying, fake reumes (like you have), then get into a project, get fired in 1 month or 2, go on bench, unpaind, find another project by practising more lying, and so on.
My friend, I take my statement back when I included you in the genuine candidate group. You are no better than the OP. You fakers deserve to end up in prison!
To answer your original question: not a single line on my resume is fake. And I'm not working on "projects". I have a full-time job and I'm with the same employer for the past 4 years!!!!!!!!!
Get out of your desi consultancy world for a change and see how the world outside of your little fakers club works. Not everybody is lying their way into "projects".

I have a medical RFE. RFE asks me to go back to the original Civil Surgeon. Since I have moved to different place going to same civil surgeon is not an option.
Has any one run into similar situation. If so please share your experience.
Maybe the IO is asking you to go to the original civil surgeon so they can make a correction/addition to the original.
I would advise you to get the whole medical redone from a new doctor(close to your home). This way IO doesnot have to compare the original and the additional results as per the RFE.
I went to a different civil surgeon as i had moved to a different state. Some doctors have a standard fee for immigration medical. Best would be for you to get the whole medical redone and submit. Take a copy of your previous medical so they can copy your immunization records. This way you can avoid some vaccinations:)

I am also in similar situation although no RFE yet. I have submitted a non-availability of birth certificate letter and affadivit of parents. I have the following questions
(1) Do we get the letter from the muncipal office from the place of birth or we can get from the muncipal office that we are presently residing. (birth was in UP , residing in TN) I believe the non-availibility certificate has to be from the jurisdiction of the birth and not current residence
(2)What is the letter for , is it for birth certificate or for non availability of birth certificate. If you were born before a certain year (not sure about the exact year) there is a great chance that your birth was not registered. That is why you have to ask the local authority to search the records and give you a letter saying that such and such person's birth was not registered and no records exist
(3) Is there any body who has gotten a letter post a copy. (after removing personal details.)
Hope this helps. Again most of what I mentioned is information gathered from such postings here and there.

My apologies if this is not the correct thread (but I think it is related).
It has been a month since USCIS received the response to a EVL related RFE issued to me. I verified the receipt date from uscis.gov. Does anyone know how many days it takes (on an average) for them to decide upon such RFE? I am trying to make sure if it is too late and I should request an appointment through infopass.
Thanks!

1. If I-140 is not yet approved and withdrawn, you lose I-485/AP/EAD.
2. I am not sure why they cannot file a second I-140 based on PERM LC right away. Seems to be a no-brainer to me. Must be one of those lawyer things :)
http://www.hooyou.com/eb-1/faq.html
Q: Is it possible to file two petitions, such as an EB-1(a) and NIW, at the same time?
A: Yes. Some of our clients file two I-140 petitions simultaneously. Some clients file three I-140 petitions at the same time. There is nothing stated in the law that prohibits multiple filings. Multiple filings increase your chances of approval.

That would be the way to go. I assume you will probably look at a career change or change the job responsibilities in the same field, which may be a factor for the prior GC going to the boondocks. If on the other hand, you intend to stay in the same field and similar job profile, then striking a deal with your employer (that you would come and join them after your MBA) would be a way to keep your current GC process going. A leave of absence in that case would be the way to go.
You will get jobs easily in Europe after an INSEAD MBA. Why bother about coming back to US, and getting in the GC queue again?

Exactly. No one is comparing USA & CANADA.
For the ppl who say no jobs in Canada - well find a job and then move there. Or live in Canada in border town and commute to work daily to US.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.
You didn't say any where in your message that TSC applicants are getting RN very late. Sorry to say but it seems you are very mean and selfish person. But looking at only NSC your concern is currect.
I think we are united here.

Immigration and education should be two seperate things. NO support to categorize further on immigration, We should take out the country cap. It should be First come first serve basis. with necessary background checks on education and skills.
I welcome this sane voice
Come on folks, the reason we are suffering today is this mentality of whipping, punishing ourselves. Why do you want to go through the wall of fire, when people out there are trying the easiest means out? WHY? Why do you want to put us all through even more punishment? Please, drop these kinds of threads
I see that 2 people have given reds for this comment. I also see why British was able to enslave India

Glad to see there is some hope in future for EB3 I.
But we shouldn't rest on these hopes. If we can get at-least couple of items on IV agenda (recapture , STEM) passed we should all be greened for sure.
Heres hoping for the best.
