Relax I had the same issue and lawyer resolved the discrepeancy by showing the encashed cheques to USCIS. I got FP notice and going for FP nextweek.

Just ask the lawyer to send the proof and money paid to uscis and ur good to go...

Filing seperately is probably not a good option. Since spouse on ITIN, means no income. Given this, the amount you loose on deductions for single will morethan offset the $600 you get.
So one should file joint, and wait for SSN and claim the rebates. I think you can claim the rebates anytime within 3 years. Just sharing what I read in other related threads before and made sense to me.
All said, I still don't know why they ask SSN. Some say for better disbursement of funds etc. But that doesn't make any sense to me. They always make life harder for aliens. Probably they couldn't find a solid excuse to deny rebates to H1B-SSN's. Otherwise this would have been a bigger curse. Most of us got lucky, or they just felt spouses with SSN more likely either both working or primary contributed taxes for many years, so its okay to give back some. whatever reasons behind it..

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 quota problems, GC backlog processing etc.
As most Americans are not aware of employment based GC, I think a professional documentary makes more sense than a full length movie. (I wonder why Michael Moore didn't attempt this before :rolleyes:)
Portraying the GC limbo of skilled immigrants to Americans on a full length comedy movie would be like explaining Einstein’s “Theory of Relativity” in cartoon to a bunch of ditsy blondes. Infact, a few movie critics who might have vaguely understood the movie would comment like "Two thumbs up for an honest, emotional, funny and deeply moving portrait of ILLEGAL immigration” :)

I found a very detailed discussion thread (http://immigrationvoice.org/forum/showthread.php?t=5890) about good/bad experiences with different immigration lawywers. This was back in July Last Year when most ppl were filling for 485.
Now many of them are invoking AC21, can some one share experience with AC21 attorney representation?
I know we do not need an attorney for AC21, but I am inclined to go with one just for the peace of mind.
After carefully reading thru' every post on above thread, calling some friends and my own online research, I am thinking of either Rajiv Khanna or Ron Gotcher. I have a close friend who is with Rajiv Khanna for a long time and has good words for him. But I personally do not know anyone who is currently a client with Gotcher Law firm. If there is anyone who has specific experience or recommandation with Gotcher Law Firm or any other, please share.
On a side note, my current company's corporate attorney is very rude, not-apporachable and very costly. Never replied to emails or phone calls. Also by contract, I can not have him represent my case, once I resign from my current position.

I saw you post regarding the case being transffered to Des Moines Iowa. My case has the exact same update as of March 19 2008. Its been like that since then. Yesterday, I spoke with an IO from NSC and she told me that my case is picked up for Extended processing. I am not sure what it means!!! I have applied for my EAD and AP renewals and asked her about the status of those in light of the pending additional processing of my I485. She told me that my EAD and AP renewals also would be held up until the additional processing is completed. On pushing again, she told me that in case my EAD is due for more than 90 days, i would have to walkin to a local center and get an interim EAD. I am inferring that it may be a pending interview call. My attroney also said the same thing. I dont have any criminal background, didnot do anything illegal in terms of immigration like being out of status or on bench.. So my best guess would be that its a pending interview. I had taken a infopass appnt last month and the officer in my local office also told me that my ead and ap renewal would not be approved until additional inquiry is completed. I am quite concerned and confused from last month as to what is wrong with my application to warrant a refusal of my EAD.
Lately, I have been observing several people have their cases transferred to Des Moines Iowa and interestingly around the 19th of the month. I am guessing USCIS moves cases around the 19th to the local offices

It just means that your case will be now processed at a local office. I mean to ask if Des M office the closest USCIS office to you? There is a good chance of interview here......its random so dont worry about it. When USCIS will call you for interview they will send a list of what to bring and you can search on IV for a post where I had mentioned what kind of questions USCIS officer asks. Hope this helps.

If that is such the case, ISO800 is noisy and you can't really shoot above that.
but judging by comments elsewhere, the resolution is very good on lower ISO shots. (better than the 1D Mark II some say?)
It's also a model that has been out for a while. A replacement is overdue? (Photokina...)
If we're talking strategy :p, then I believe this is the time to consider waiting. Almost every camera except the 1D Mark II will likely be superceded by newer and cheaper models come September. (10D, S2, 300D, D70 and perhaps Sigma SD10 is my guess) That date is not that far off... (usually no point in waiting, but if the original poster already has a camera and is in no rush...)

Not sure if anyone experienced this, but on 2 computers this site, antivirus software detected a virus & my work PC (protected with McAfee) is not booting up, IT said my hard drive has been corrupted. My laptop survived with a freeware anti virus. Please don't give me reds, this is what happened to me, I just wanted to warn any unprotected members of IV.

USCIS Knows the numbers now or they would not predict April 2006 if they did not know. I believe that If you read the predictions of QSK then you will know exactly what might happen. It will go up to Sep 2006 and might stay there or move back to April.

Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

I don't think the state is involved, but its the institution that makes its own set of rules. All the community colleges in the state of Arizona accepts both H and L status as proof of residency.

One of friends got advice from a tax consultant about the 401K withdrawal question you have. The best approach in this case would be to phase out the withdrawal amounts over a period of successive years. When you are in India, you are not earning US income. So say if you take 10K the first year, it will be considered income earned in US for which you have to pay tax. Since 10K is below the standard deduction amt, you will not have to pay any tax. The penalty will still apply as you are breaking the 401K.

Yup - that response looks very similar to the Feinstein response I got. I wrote back to correct her staff on the intent of my original letter, using some of the information and stats from IV.
If you feel as frustrated as I was with the Spam you received back, you could try the same tactic. I have, as yet, not received a response though :)
